Nigerian youths dissociate selves from proposed protest against service chiefs

Nigerian youths under the aegis of the Emerging Leaders Forum of Nigeria (ELFON), Youth Assembly of Nigeria (YAN) and Nigerian Students Parliament (NSP) have dissociated themselves from a protest against the country’s service chiefs.

The protest is scheduled to hold tomorrow, Thursday, February 20, 2020 but the three groups, along with representatives of various Students Union Governments across the country this evening washed their hands off the event.

While admitting the country’s precarious security situation, they said during a press conference addressed at Agura Hotels, Abuja by National Speaker of YAN, Amb. Godstime Chukwubuikem Samuel, and NSP National Speaker, Rt. Hon. Mubarak Aliyu Rimi: “The call for protest against the service chiefs, the call for the sacking of the service chiefs is not done in the best interest of Nigeria.”

The pro-protest youths under the aegis of the Coalition of Nigerian Youths had earlier invited ELFON, YAN and NSP to mobilise their members to Millennium Park, Abuja, by 10am tomorrow but the three groups after consultations with their members opted not to be part of the protest.

CALSER writes PMB over terrorism, wants Zulum, Borno elders to appreciate military

The Centre For African Liberation and Socio-Economic Rights (CALSER), on Wednesday, penned an emotional letter to President Muhammadu Buhari on the war against terrorism, calling on Governor Babagana Zulum and Borno elders to support the military.

In the letter signed by convener Princess Ajibola, CALSER revealed that the governor as well as the political elites in the state aren’t giving enough moral support to the troops on the frontline.

At every slightest opportunity, the group disclosed that the Borno leaders criticize the military, ignoring their tremendous sacrifices for the safety and peace of his people.

While peace have been restored to neighbouring states, insurgency is on the rise in Borno and CALSER believes this is as a result of the state’s elites deliberately declining in playing complementary roles to the Nigerian military.

The group, therefore, besieged on the president to intervene and ask the Borno governor and leaders to provide complementary credible intelligence information to the troops.

In situation where this fails to happen, however, CALSER called on the president to declare a state of emergency in the state.

Your Excellency Sir,

Thee Centre for African Liberation and Socio-Economic Rights (CALSER) wishes to mourn with you, Nigerians, the Borno State Government and the families of victims of recent terrorists’ attacks in Auno, Borno state.

We deeply appreciate the overt zeal, determination and commitment on the anti-terrorism campaigns of your administration these past years.

Before your intervention in the Boko Haram terrorism scourge, insurgents raged, tormented, devastated and ruined many parts of Northern Nigeria, particularly, Borno, Adamawa and Yobe states. Even the Federal Capital Territory (FCT) Abuja was not spared its fury and agonies of terrorists.

In the last near five years, your tested and vast knowledge in military welfare coupled with the carefully assembled team of Service and Security Chiefs (SSCs), Nigeria has been able to decimate and technically defeat Boko Haram terrorism.

Sir, it attracted national and international accolades to Nigeria, yourself and the Nigerian military for this wonderful feat. In fact, even the ardent critics of your Government have repeatedly applauded you on this! Respite descended everywhere including the Northeast where Boko Haram had firm roots.

The launch of the Nigerian Army’s series of clearance operations in the Northeast, the decongestion of IDPs camps and the setting up of the North East Development Commission (NEDC) by your Government are practical signs that normalcy returned to the once troubled region.

Painfully though, the unpatriotic activities of politicians in the build-up to the 2019 general elections saw the proliferation of arms and ammunitions and the resurgence of pockets of violence and killings in parts of Nigeria, terrorism inclusive.

But the FGN under your leadership has not relented in countering these fresh threats of insecurities and the Nigerian Army is also working tirelessly to rid Nigeria of all forms of terrorism. But why the Nigerian military is doing its best to ensure the country buries the ghost of terrorism, some elites in Borno are working day and night to frustrate your administration from finally eradicating terrorism.

And we have noticed that this suspected sabotage is more pronounced in Borno state, the former epicentre of terrorism and where it was birthed and nourished. The political leadership of Borno state and the elites have deliberately declined in playing complementary roles to the Nigerian Military to end terrorism.

While sister states like Yobe and Adamawa states are relatively peaceful and secured in spite of resurged Boko Haram/ISWAP terrorism; Borno state has remained a burning furnace on the altar of terrorists. The momentum Boko Haram has gained in Borno which is seriously competing with soldiers to diminish the successes recorded by your Government in combating terrorism is bothersome.

CALSER recalls the words of the Shehu of Borno, HRH Abubakar Gabai when you visited to pay condolence and commiserate with people of the state over Boko Haram’s recent massacres of travelers at Auno village. The monarch bluntly acknowledged that the security situation in the state had once improved until recently when “it has resurfaced.”

Permit us to quote the Governor’s words again; “But from May 2015, we have recovered most of the displaced local government areas. By the year 2016 and 2017, we have almost celebrated the demise of the Boko Haram insurgency. But from March 2019, we have started recording simultaneous attacks and increased activities of the insurgents which have resulted in the loss of lives of our people.”

These are confessional statements from top leaders of Borno state on the efforts of your administration in extinguishing the fires of Boko Haram and ISWAP terrorism. But the same leaders, elders and community leaders in the state have declined in reciprocating your efforts.

And like you rightly observed in your last condolence visit to Borno, their refusal to provide complementary credible intelligence information to the Nigerian Military to act on terrorism as every situation deserves.

Therefore, like you have stated, CALSER also concords with you that the leaders and elders of Borno communities are not doing enough in terms of cooperation with the military to end the Boko Haram/ISWAP terrorism, in the state. Boko Haram quite frankly cannot transit wherever they are domiciled into Borno, camp for days, finalize preparations’ and bloodily strike targets without the knowledge of community leaders.

Your Excellency sir, equally disheartening is the tendency of Gov. Zulum to blame the Military at the slightest opportunity almost each time there is a Boko Haram invasion. Like in the latest Auno incident, the Governor blamed the military for its inability to protect the people on the highways. It is an indication that the Governor and his elders have lost traction in playing complementary roles to the military on ending insurgency.

But Gov. Zulum does not remember to even thank the Nigerian Army anytime it averts or repels Boko Haram or the sacrifices they are making for the security and peace of Nigeria. Since your visit, Nigerian troops have repelled terrorist’s invasion and bloodshed at two separate instances in the state. Gov. Zulum has never mentioned it.

From the Governor’s disposition, its clear to us that he neither understands what it takes to be the Chief Security Officer of a state nor is deliberately frustrating your efforts at ending insurgency. The Governor and the elders are acting more like an enemy or antagonistic force or conspirators against the Nigerian Military operating in his state in the counter-insurgency operations.

It was very discouraging and unimpressive when Gov. Zulum again blamed the military in your presence. He unashamedly said; “We are calling on the Nigerian military to retrace their steps and replicate the successes they have recorded in 2016 and 2017 so that we can end this insurgency once and for all.”

He knows our military have the capacity to repress and completely impair terrorists. But how could they again replicate these exploits when Gov. Zulum, other elders and community leaders in Borno are discreetly frustrating their efforts? How could the Army do it without good intelligence or cooperation of the local populace?

These leaders have refused to place themselves in charge of security in their respective domains. The terrorists who struck at Auno did not assembly there in a jiffy or overnight when travelers were stranded on the road to launch the attack. The terrorists must have camped in the vicinity for long and scouting for an opportunity to strike, but no one averred intelligence report to the Military. But the only concern is to blame the FGN or soldiers when an attack is unleashed.

This conduct by Borno leaders is condemnable, self-indicting and objectionable. Outside hoarding intelligence information and courting of terrorists, Borno elders and elites, including Gov. Zulum have refused to address the massive youth economic empowerment and employment deficit to break their passion and cord with terrorism. The youths are the foot soldiers hired by terrorists.

Borno elders have never considered the option of a broad-based dialogue forum with their people to also discuss the menace of Boko Haram. No elder or leader is thinking of this initiative and collectively, as Zamfara state Gov. Bello Maradun Matawallen did in the case of banditry in the state.

CALSER has no hesitation to say, we have observed these trends in Borno and the state deserves a full declaration of a state of emergency. It is only a complete state of emergency in Borno State that can re-restore order and security to the people.

Borno Governor, elders and leaders have refused to do the needful. We have reason to agree with the postulations in your speech in Maiduguri that the political class/leaders in Borno have failed the state and the people.

Your Excellency, if Borno Governor, elders and community leaders have failed the state, but Nigerians will not fail Borno. And the first step now is to declare a full-blown state of emergency in the state.

Western nations sponsoring Amnesty International to destabilise Nigeria -AU

The Economic, Social and Cultural Council, one of the organs of the African Union, on Wednesday said Western countries are sponsoring Amnesty International to destabilize Nigeria.

Leader of a delegation of the group, Mr Tunji Ashaolu, stated this during a courtesy visit to the Chief of Army Staff, Lt General, Tukur Yusuf Buratai at the Defence Headquarters, Abuja.

He said, “You have reorganized the army through professionalism and has retrained them, adding that the Army has been experiencing rapid promotion.

He added, “You have established human rights desk in all the Army formations. If you have been able to do this, I don’t see why some group would say that you are violating human rights. Someone violating human rights would not establish those desks.

“I think they have put this in place not only to undermine your office but the Nigerian government.

“The Amnesty International that is saying you are violating human rights is being sponsored by western people,” he said.

“You have won the war against terrorism. There was nothing like Boko Haram before, it came, you are facing it, tackling it and winning it. You have worked effectively in civil military relations and you have supported democracy to succeed in Nigeria.

“I, on behalf of AU, Economic and Social Council, passed vote of confidence in the Nigerian Army under your leadership”.

“You have done it all, all you need is encouragement”, he added.

Continuing he said, “We are here to tell you, we are behind you. African Union is behind you. It means you have to do more. We are not partisan, we are not politicians, and we can’t be used.

“Whatever we see, we say it. You have done a lot. And we are now saying enough is enough for international organizations to be using Amnesty International as part of their foreign direct agencies to destabilize the government of Africa which we will not take any longer.

He explained that the group had the capacity and willingness to “step in, in empowering the youth in the North east, train them and empower them.

“Terrorism has a link with poverty. We can partner with Institute for Peace and Conflict Resolution to do this job,” Ashaolu said.

In his remarks, the Chief of Army Staff said, “This visit is a morale booster. This has increased our confidence, that we are being appreciated not only in Nigeria but across the continent and globally.

“You have come with a message from the African Union. The AU Agenda 2063, of silencing the gun is a laudable initiative. It should be imbibed by all and sundry.

“We have had this challenge for a long time, the proliferation of Small Arms across the country.”

Buratai said the Nigerian Army has been working with other security agencies to ensure that the menace of proliferation of small and light weapons is addressed.

He said the “borders are being properly monitored to check smuggling, human trafficking and other vices” noting, “these are efforts supporting the “AU silencing the gun”, agenda.

Emphasizing that the Army is reinforcing the security at the borders, the COAS said, “The country has a national data on recovery of light weapons” and strategy to verify, to know countries of origin of recovered weapons.

“Efforts to address security challenges in the country include the kinetic and non-kinetic approach. We do carry out information operation and De-radicalization where our soldiers are involved in teaching in IDP camps in collaboration with civil societies and other security agencies.

There is also bilateral cooperation. What army personnel need is support and not condemnation and we want to call on all international organizations operating in the country to have a rethink and support Nigeria in winning the war against insurgency.

He disclosed that some Boko Haram terrorists that were captured had locally produced ammunition assuring that such a situation is being addressed by the government.

While urging everybody especially critics to have “a rethink and come to support the fight against insurgency, Buratai said, “Come, let us focus effort to solve the socio-economic situation in the country; to ameliorate the suffering of the people instead of vilifying the men and women working hard to make the country safe.

“We can’t go back to how it was. We cannot go back to 2015 until insurgency is eliminated.”

Towards setting the narratives straight on the issues of the Islamic Movement of Nigeria for the understanding of their nefarious plans against the unity of the nation, a book exposing the evils of Ibrahim El-Zakzakky and his shittes movement, the Islamic Movement of Nigeria has been unveiled in Abuja.

Speaking at the occasion, Chancellor of Centre for International and Strategic Studies CISS Prof Ahmed Danfulani noted that the mission and vision of IMN has not been officially stated however, El-Zakzaky has severally made statements that mirrors the missions, goals and intentions of the group.

“Their mission as an extremist organisation has also been captured in their official websites etc. What is known about their mission and vision could be seen when a careful study of their confessions and professions is embarked upon.

“Their sole mission which is to establish an Islamic state has been politically resisted by the government and other religious groups, however the IMN have also engaged in violent acts that could be regarded as terrorism.

“It should be noted that just like how Boko Haram started, the activities of IMN is taking to the same pattern and process.

“The Mission and vision of IMN show their disregard for the Nigerian state and deliberate intensions to overthrow the Nigerian government through violent means” he added.

The governor of Benue state, Samuel Ortom who was distinguished guest of Honour at the event described the author, Terrence Kuanum as an astute young man who has survived many battles most of which were in the interest of the peaceful coexistence of Nigeria.

Represented by his Senior Special Assistant on Liaison, Hon Baba Acka, Governor Ortom called on Nigerians to unite with a view to fighting the common enemy of the Nation.

In his remarks, the author of the book, Mr Terrence Kuanum emphasized that the project became necessary because some international actors have begun taking advantage of the security situation in Nigeria Which has made it difficult for citizens to coexist together as Nigerians.

He lamented the number of lives lost across the nation because of non-state actors who have continued to set the narratives to destabilise the nation through violent agitations for their own selfish interest.

“At a point our sovereignty was questioned because someone else was setting the narratives for us” he noted.

He called on Nigerians to have confidence in the nation and trust our institutions while countering the narratives aimed at destroying the stability if the nation.

Other personalities who graced the occasion include, Professor Ahmed Danfulani, former speaker of the Benue State House of Assembly Hon Terkimbi Ikyange, Hon Nick Eworo and a host of others.

Honourable Eugene Aliegba, former Commissioner for Education and lecturer was the Chairman of the occasion.

Imo: PDP wants CJN barred from hearing fresh appeal

The leadership of the People’s Democratic Party (PDP) has asked the Chief Justice of Nigeria (CJN), Justice Ibrahim Tanko Muhammad to recuse himself from the hearing of the review application on the Imo State governorship election petition.

The party has also, made a similar demand on six other justices of the Supreme Court that presided and delivered the January 14 judgment on the 2019 Imo State governorship election petition.

The other six justices are Justice Nwah Sylvester Ngwuta, Justice Olukayode Ariwola, Justice Kudirat Kekere-Ekun, Justice Amina Adamu Augie, and Justice Uwani Musa Abba Aji.

The apex court will on Tuesday hear the application for review in its judgement that sacked Mr Emeka Ihedioha of the PDP as Imo State governor and replaced him with Senator Hope Uzodinma of the All Progressives Congress (APC).

The PDP, in a letter to the CJN, dated February 14, 2020 and signed by the Chairman, Prince Uche Secondus and National Secretary, Senator Ibrahim Tsauri, predicated the demand on grounds of likelihood of bias and the need to ensure fair hearing.

The party emphasised that it had become very imperative that the CJN and the other justices that served on that panel be replaced to ensure that fairness and justice is not only done, but also seen to have been done.

The letter said in part, “As a follow up to our earlier call on all members of the panel to recuse themselves, we have now sought to formalise that request or demand.

“We hereby request that the seven persons that heard the case earlier recuse themselves from participating in the consideration of this new application.

“We are not unmindful of the fact that a litigant cannot dictate to the court the panel that should hear its case. However, due to the extraordinary circumstances and the nature of this case, we think that our request is a fair one that meets the justice of the case.”

“Consequently, we feel it as our patriotic duty to hereby humbly request that your Lordship constitute a different panel of this great court (other than the one that delivered the judgement) for the purpose of hearing this application”.

According to the main opposition party, the judgment of the apex court on the Imo election should be set aside because it has continued to generate misgivings in the polity and introduced uncertainties in the nation’s electoral jurisprudence.

It added that the judgment has the potential for crisis in the nation’s democracy, owing to what the party described as the irreconcilability of the calculations contained therein and their resultant effects.

It continued, “Your Lordship would recall that a panel of Hon. Justices of the Supreme Court presided by your good self on Tuesday the 14th day of January 2020, delivered judgement on the above appeal.

“Your Lordship may further recall that on February 5th, 2020 the People’s Democratic Party (PDP) filed an application praying that the judgement of 14th January 2020 be set aside on grounds of nullity of the judgment, among other grounds.

“The judgement sought to be set aside has generated so much misgiving not only among lawyers but in the general polity as a whole because of the uncertainty it has introduced into our electoral jurisprudence, its potential for crisis in our democracy, the irreconcilability of the calculations contained therein and their resultant effect.

“At the heat of the moment, the Party addressed a Press Conference and expressed its displeasure and disagreement with the judgement, and called on the Justices that heard the case to recuse themselves during any possible future review of the case that may come before the Court, the Party even went further to ask the President of the Court to even resign.

“As a follow up to our earlier call on all members of the Panel to recuse themselves, we have now sought to formalise that request or demand. We hereby request that the 7 persons that heard the case earlier recuse themselves from participating in the consideration of this new application.

“My Lord, our request is founded on Section 36(1) of the Constitution of the Federal Republic of Nigeria, which guarantees fair hearing to every citizen or entity in the determination of his rights or obligations.

“Furthermore, the time honoured and tested principles of natural justice, particularly that no man shall be a judge in his own cause is particularly relevant to this solemn request.

“Allegation of bias or likelihood of bias goes to the root of fair hearing. Denial of right to fair hearing is a logical consequence of bias in any proceeding before a Court or a tribunal.

“The Constitution of the Federal Republic of Nigeria, 1999 as Amended (Constitution) guarantees the right of an individual to fair hearing. An individual’s right to fair hearing includes the right to have his/her rights and obligations determined by an independent and impartial tribunal.

“The above is clearly enshrined in Section 36 (1) of the Constitution, which provides as follows: ‘In the determination of his civil rights and obligations, including any question or determination by or against any government or authority, a person shall be entitled to a fair hearing within a reasonable time by a court or other tribunal established by law and constituted in such manner as to secure its independence and impartiality’

“The right to an independent and impartial tribunal is a major factor in determining if fair hearing has been observed by a Court.

“The relevant question on the issue of bias is what an ordinary man on the street would think about the fairness of the proceedings conducted by judges accused of likelihood of bias.

“We may even be wrong on the allegations made against the learned justices of the Supreme Court that sat on the case in question. We may have been bitter about the clearly observed inadequacies in that judgment, but this is now beside the point.

“The relevant question is: can any reasonable person who heard the Press Conference and several protests by the Party, PDP, the Civil Society Organisations and Nigerians generally, all over the country, including foreign embassies, the involvement of even the international community, feel that the same panel that has been the subject of these allegations, rightly or wrongly by the Party, can sit and deliver impartial justice on the same case on review? We think not”.

New electricity tariffs takes effect from April 1

The Nigeria Electricity Regulatory Commission (NERC) has directed the 11 electricity distribution companies (DisCos) to hike their tariffs by average of 50 percent on April 1.

Ikeja Electric (IE) Plc, which made this disclosure in its memo to the commission, noted that the directive is “in order to meet the tariff shortfall funding target from 2020 by the Federal Government of Nigeria.”

Owing to the directive, the 50 percent tariff increase is expected to raise the average tariffs from the current level of 27.30 N/kWh to 40.95 N/kWh, according to the Chief Executive Officer, Anthony Youdeowei.

The memo that The Nation sighted in Abuja on Monday was dated February 12, 2020.

The power distributor titled the document: “Re: Addendum to Ikeja Plc’s Performance Improvement Plan and application for extraordinary tariff review of MYTO-2015.”

NERC, according to the IE document, said: “The objective for the extra-ordinary tariff review of MYTO-2015 is to ensure Ikeja Electric adjusts its tariff in line with the commission’s directive that current average allowed tariff shall be grossed-up 50% from April 2020.”

IE informed the commission that in line with the directive “we have designed the tariffs based on the MYTO tariff model contained in the document, ‘Ikeja DisCo Tariff Model Jan 2020’ shared with IE by the commission.

“In this application, we intend to create a new tariff class, called Bilateral; a class that is being created for customers that IE has a signed Power Purchase Agreement (PPA) with under a willing-buyer-willing seller arrangement. In order to provide an efficient and reliable service to customers in this tariff class, cost-reflective tariffs are required to cover the cost of service delivery.

“Our total bilateral energy procured is currently 200MW, however, bilateral sales in this application, is only the portion of the bilateral energy that has been contracted with customers on a willing-buyer-willing seller arrangement.”

The power firm said that the expected MYTO 2020 and bilateral revenue requirement are collected sales (GWh) in MYTO is 3,955mw, and bilateral 161mw, total 2020 for 4,116mw.
