Court of Appeal affirms Rep Etteh’s election

Okpolupm Etteh of the Peoples Democratic Party (PDP) was recognized as the representative of the Eket/ONNA/Esit Eket/Ibeno Federal Constituency of Akwa Ibom State by the Court of Appeal, which was located in Lagos. Eseme Eyiboh of the All Progressives Congress (APC) filed the challenge, but it was dismissed for “lack of merit.”

Judge Jummai Hannatu C. Sankey led the panel that rendered the decision on Thursday.

In the decision, the chief judge stated, “We all agreed to rely on the comprehensive decision of the Justice Kudirat Jose-led Tribunal, which had confirmed Hon. Etteh, the victor of the February 25, 2023, House of Representatives election for the Eket/ONNA/Esit Eket/Ibeno Federal Constituency, as announced by the Independent Electoral Commission (INEC), with 33,001 votes against Eyiboh (16,909 votes)”.
The court ruled that Eyiboh, who claimed that Etteh’s certifications were faked based only on conjecture, must give N300,000 to each of the respondents.

Recall that Eyiboh had petitioned the Tribunal to void Etteh’s eligibility and declare him the election winner on the grounds that Etteh, the PDP candidate, had falsified his certificate, making him ineligible to run for office.

According to former President Goodluck Jonathan, Nigeria needs to advance.

After visiting with President Bola Ahmed Tinubu to congratulate him on his Supreme Court triumph, Jonathan made this statement in Abuja. Following the Supreme Court’s ruling on Thursday regarding the appeals filed by the People’s Democratic Party (PDP) and Labour Party (LP) candidates challenging the ruling of the Presidential Election Tribunal Court (PEPC) that confirmed Tinubu’s victory in the election held on February 25, 2023, Tinubu emerged victorious.

But in response to the Supreme Court’s decision, Jonathan—a representation of democracy and harmony in Africa—thought that the elections were over and urged all political leaders to unite in order to advance the nation.

“The nation must move forward,” he said. Now that the elections are finished, we must proceed. When Prof. Lumumba appeared at one of our programs, he underlined the necessity for Nigeria to lead in Africa. Even though the economy is challenging right now, we still possess leadership qualities.

These are some of the topics we will continue to talk about, and since they are not personal matters, I will also update the president on all of my overseas programs.

“Traditionally, you come home and tell Mr. President if a former president leaves the nation for continental or regional programs, even some national ones. That is the custom, then. A House of Representatives caucus has applauded President Bola Tinubu and the Group CEO of the Nigeria National Petroleum Company Limited (NNPCL), Engr. Mele Kyari for reviving the oil and gas sector.

The Friends of the Masses, a caucus consisting of over 50 members drawn from across the country, made this known in a joint statement signed by Hon. Seso Ikpagher (Benue, APC) and Hon. Iyawe Esosa (Edo, LP).

The Caucus described Kyari as the best thing to happen to Nigeria’s oil sector, adding that the Petroleum Industry Act 2021 is one of the numerous reforms birthed by the NNPC GCEO.

The lawmakers said the PIA is the most audacious attempt to overhaul the petroleum sector, once bedevilled by controversies and uncertainties.

While admitting that the expected gains of the Petroleum Industry Act have not been fully actualised, they expressed optimism that with Kyari, Nigerians can be hopeful.

The group further hailed Kyari as the game-changer in the oil and gas sector not just in Nigeria but the continent.

The lawmakers said the NNPCL GCEO came at a turbulent period characterised by low production, burgeoning vandalisation of oil pipelines, oil theft on a grand scale, and demoralised staff of the company.

However, just a little over three years later, he said the story is different.

“The signing of the PIA by former President Muhammadu Buhari was perhaps the biggest breakthrough for Kyari as it opened the door for more significant changes in the national oil giant,” the statement said.

“We can’t forget how he worked for the passage of the PIA. Today, we have a new, refreshed, and rejuvenated NNPC. He has gone a step further to initiate new investment benchmarks to further rejuvenate the once-ineffective company.

“Nigeria’s oil and gas industry is now on a transformative path, unlocking opportunities for growth and prosperity in the sector. The end of the fraudulent subsidy regime was another milestone.

“Under the leadership of Kyari, the company has taken significant steps towards enhancing transparency and accountability in the industry. One of the ways he has done this is by publishing monthly financial and operational reports.

“For Kyari, it is about the country. And together with other distinguished colleagues, we have vowed to support him in breaking new grounds and achieving more”.

All police barracks nationwide should be put up for auction, due to a request made by the House of Representatives.

A public offering for all federally held barracks nationwide should be announced as soon as possible, according to a request made by the legislators to the Ministry of Interior and the Ministry of Police Affairs to coordinate with the Bureau of Public Enterprise (BPE).

Following the House’s passage of a motion of urgent public significance regarding the need to address the appalling living conditions of Nigerian Police Force (NPF) officers, Hon. Murphy Omoruyi raised the issue of the resolution.

Presenting the motion, he reminded the audience that the Police Reform Bill 2020 was approved by the National Assembly in September 2020 and signed into law by former Nigerian President Muhammadu Buhari on September 16, 2020.

Addressing the living conditions of the nation’s brave police officers was one of its main concerns, he said.

The lawmaker pointed out that the issue of providing police officers with decent housing endures and has outlasted all prior attempts at solutions.In spite of all efforts, Omoruyi noted, barracks are still unable to provide for basic requirements due to their current state of neglect and decay. She emphasized that the federal government spent more than N5 billion on barracks restorations between 2019 and 2022.

The congressman brought up the heated national discussions and demands for more community-focused policing tactics, pointing out that having police officers live among the general people instead of in their isolated barracks would greatly allay these demands and improve public safety.

The accommodation of police and local law enforcement officials in barracks, according to Omoruyi, is a remnant of colonialism that the same colonialists had long since abandoned back home.

He voiced concern over the state of filth that police officers and their families endure nationwide, a condition marked by enormous wall fissures, bat infestations, leaky roofs, and run-down barracks.

In response to the Supreme Court’s ruling upholding his election and rejecting his opponents’ challenges, President Bola Tinubu has spoken.

On Thursday, the Nigerian Supreme Court upheld President Bola Tinubu’s victory in the presidential election held on February 25.

After rejecting the appeals submitted by Atiku Abubakar of the Peoples Democratic Party (PDP) and Peter Obi of the Labour Party, respectively, as well as the parties, the top court upheld Tinubu’s victory.

On September 6, the Presidential Election Petition Court dismissed the petitions, and the appellants filed appeals to contest that decision.

The Independent National Electoral Commission (INEC) had declared Tinubu the victor of the February presidential election, but the candidates and their parties were contesting this result.

The Presidential Election Petition Court’s decision to reject Atiku and Obi’s petitions due to lack of merit was affirmed by the Supreme Court, which also rejected their appeals for lack of merit.

“We have concentrated on pulling Nigerians from the bootstraps of depression, and we understand the suffering of the country; we don’t need additional distractions to be able to concentrate on building a new economy for the people, an inclusive one, for that matter,” the President said in response to the ruling shortly after winning the case at the top court.

“And innuendos, antics, and trial lying in the media and public domain were all stopped by the Supreme Court’s ruling. The court has shown an unwavering dedication to the rule of law, humanity, and the administration of justice for all Nigerians, irrespective of their race, religion, or any other prejudice.

John Okoro, the panel’s presiding justice, declared earlier on Thursday that the election’s results were unaffected by INEC’s failure to send the results. This issue is therefore decided against the appellants.

I applaud the decision made by the Justice John I. Okoro-led panel of the Supreme Court on the presidential election petitions that the candidates of the Labour Party and the People’s Democratic Party filed to overturn the Presidential Election Petition Tribunal’s decision.

Without fear or favor, the court has treated all of the matters raised in the petitions fairly and on the basis of the law.

With today’s significant ruling, there is no question that the Honourable Justices’ diligent work and unwavering professionalism in overseeing this case have contributed to the further consolidation and deepening of our constitutional democracy and electoral jurisprudence within the fabric of our nation.

While the contentious debate over who actually won the 2023 presidential election and satisfied the legal requirements outlined in the constitution has been put to rest by today’s verdict, I want to stress that my confidence in our country’s legal system has never wavered—not even for a second—because I am confident that our sacred courts will always provide justice to all Nigerians, in every situation. The judiciary showed its unwavering dedication to preserving the rule of law for the advancement and defense of mankind in the face of intense pressure and intimidation tactics from certain political figures.

Today, it was confirmed once more that the All Progressives Congress, the party in power in Nigeria, had legitimately and freely won the popular vote. This has allowed me to lead this wonderful country during a turbulent time of historic reforms in its history.

I embrace today’s judicial triumph with solemnity and humility, full thankfulness to God Almighty, a strong feeling of duty, and a strong willingness to meet the enormous problems that face our people.

Today’s triumph has given me even more energy and reaffirmed my resolve to serve Nigerians of all political stripes, tribes, and religions with honor and utmost respect for their differing viewpoints and shared values.

The Supreme Court, on Thursday, affirmed President Bola Tinubu of the All Progressives Congress, APC, as the valid winner of the presidential election that held in the country on February 25.

In a congratulatory message to the President, Sen. Uba said Tinubu’s victory was “truly deserved.”

He said the victory was an attestation to President Tinubu’s “doggedness and sacrifice for building and strengthening our nations democracy over the years in our collective interest.”

The APC chieftain said with the legal distractions now behind, he has implicit faith in the President’s “capacity and ability to help us build and steer the nation of our collective dreams and aspirations.”

The message read, “Mr President, l wish to congratulate you most sincerely for your hard fought, hard won and truly deserved victory at the supreme Court earlier today. Martins Esin was elected to the House of Representatives for the Oron/Mbo/Okobo/Udung Uko/Urueoffong Oruko Federal Constituency in February 2023. This decision was upheld by the National Assembly Election Petition Tribunal in Akwa Ibom state on Thursday. The Court of Appeal is located at the National Industrial Court Complex in Lagos State.

A cost of five hundred thousand naira was also granted by the three-member panel of justice in favor of each respondent, Esin, the Peoples Democratic Party (PDP), and the Independent National Electoral Commission (INEC), against the appellant.

Remember how the All Progressives Congress’ (APC) Robinson Edumoh, who lost the February elections, led the petitioners to the National Assembly Election Petition Tribunal to contest the poll’s results?

On September 1, 2023, the panel presided over by Justice Kudirat Jose dismissed Edumoh’s petition, finding that the petitioner was unable to substantiate any of his claims regarding excessive voting, failure to transmit results electronically, pervasive irregularities, and failure to comply with Electoral Act legislation.

Feeling let down by the decision, the APC candidate went to the higher court, requesting that the tribunal’s decision be overturned.

The PDP candidate, Esin, was declared the legitimate victor of the election by the National Assembly Election Petition Tribunal, and the Court of Appeal maintained this decision, ruling that there was no basis to reverse the lower court’s decision.

“Here, the Peoples Democratic Party (PDP), the Independent National Electoral Commission (INEC), and Hon. Martins Esin are the respondents, and they are all given a cost of five hundred thousand naira against the appellant.”
