Electricity consumers seek DisCos tariff audit

Electricity consumers have urged the House of Representatives Joint Committees on Power, Commerce, Delegated Legislation and National Planning to audit the tariffs paid to power distribution companies across Nigeria.

The group, under the aegis of the Electricity Consumer Protection Advocacy Centre, made this request in a letter of commendation sent to the House of Representatives for ordering the reversal of the Band A tariff.

According to the letter signed by the ECPAC Executive Director, Princewill Okorie, other affiliate organisations like the Association for Public Policy Analysis and the Electricity Safety Vanguard commended the resolution of the reversal of electricity tariff for what was termed “unconstitutionally created Band A customers” of the DisCos.

Having participated in a public hearing organised by the House on the Band A tariff hike, the group stated, “We are happy to see that the House of Representatives considered the welfare and well-being of Nigerians over self-interest and promotion of unconscionable capitalist tendencies of business operators in the power sector in deciding to reverse the unpatriotic policy of electricity tariff hike.

“By this act, the committees have proved that the 10th House of Representatives of the Federal Republic of Nigeria is actually the people’s representatives,” the letter partly read.

The group assured the House of Representatives Committee on Power of its support as non-state actors in the area of data collation and enumeration to help in identifying the number of electricity consumers in the country, the number of metered and unmetered consumers, and the investment of the DisCos in the sector.

It also planned to identify the investments of Federal, State and Local Governments, and those of consumer groups in electricity infrastructure such as transformers, cables, wires, and meters.

“We urge the House of Representatives to pass a resolution that will make the Ministry of Power carry out an audit on payments to DisCos by metered and unmetered consumers residing in urban and rural areas.

“Considering the fact that data is a very good instrument for planning and decision-making in the power sector, it would be economically and administratively wrong to discuss the increase in tariff without establishing basic facts that surveys and audits as recommended above will provide.

“We urge the executive arm of the Federal and State Governments to ensure that the resolution of the House of Representatives for the reversal of the tariff increase is enforced for the benefit of Nigerian electricity consumers,” the group noted.

The House of Representatives last week asked the Nigeria Electricity Regulatory Commission and the DisCos to reverse the tariff hike for Band A customers immediately.

The chairman of the committee, Victor Nwokolo, who presented the report, stated that Nigerians could not afford the new tariff.

However, the NERC said it was not aware of the resolution asking it to reverse the Band A tariff.

Band A customers pay about N209 per kilowatt-hour of electricity following the removal of the subsidy.

Court restricts Kwara hunger protest to Ilorin square

A Kwara State Magistrates Court has ordered the restriction of organisers of the planned August 1-10 hunger protest in the state to the Metropolitan Square in Ilorin, the state capital.

Granting an exparte order on Wednesday, July 31, 2024, the Chief Magistrate, Jibril Salihu, who presided over the court, said that he agreed with the State Attorney-General and Commissioner for Justice, Ibrahim Sulyman, that such a protest could degenerate into violence if protesters are allowed to do as they wish.

The respondents in the case are the Director, State Security Service, Kwara State; the Commissioner of Police, Kwara State Command; the Commandant, Nigerian Security and Civil Defence Corp; the Take-It-Back Movement; among others.

“After listening to Senior Ibrahim Sulyman, the Attorney-General of Kwara State, the applicant herein and after a careful perusal of the five-paragraph affidavit as well as the written address in support of the motion ex-parte, the following orders are hereby granted:

“An order of interim injunction restraining the 4th-6th respondents whether, by themselves, agents, privies, servants or any other person(s) acting through them to converge, carry, conduct any act or form of their proposed peaceful public protest, rallies, processions and or meetings in any other place other than the Metropolitan Square/Asa Dam Road, Kwara State, in the interest of the general public for seven days, effective from August 1, 2024.

“It is also ordered that the 1st-3rd respondents are directed to provide adequate security for the protection of lives and properties of all citizens and residents of Kwara State, as well as the infrastructure provided by the Kwara State Government against the 4th-6th respondents’ act, protest, or any form of protest for seven days effective from August 1, 2024, or any other day pending the determination of the motion on notice,” Salihu said.

He also directed that “all the court processes filed in respect of this suit be served on the 4th-6th respondents by pasting same at the High Court of Justice premises.”

The court adjourned further hearings in the case to August 14, 2024.

The planned nationwide protest is in response to the harsh economic realities facing the citizenry.

Five schoolchildren killed as bus, train collide in S’Africa

Five children were killed Wednesday after a train collided with a school bus in South Africa, injuring 20 others, the transport ministry said in a statement.

The accident occurred in the afternoon near the village of Mafube, close to the city of Middelburg, about 180 kilometres (110 miles) northeast of Johannesburg, according to local media.

“A tragic accident at a level crossing, involving a bus and a train… resulted in the deaths of five children and injuries to 20 others,” the government statement confirmed.

“The safety of our children is paramount, and it is heartbreaking to witness such a loss,” Deputy Transport Minister Mkhuleko Hlengwa said.
Police reported that the bus driver fled the scene after the accident, the transport ministry said.

The train driver and crew were not injured.

The cause of the accident was not immediately clear and an investigation was underway, authorities said.

Transport Minister Barbara Creecy on Wednesday evening called on law enforcement agencies “to intensify their road safety campaign involving scholar transportation, as this is the second biggest crash involving (a) scholar transport vehicle this month.”

Earlier in July, 12 children were killed when a minibus taking them to school overturned and burst into flames after being hit by another vehicle near Johannesburg.

“This tragedy, which regretfully is not the first of its kind to confront us, demands that we exercise our obligation to protect our children with the utmost care,” President Cyril Ramaphosa said at the time, offering his condolences.

South Africa has one of the most developed road networks on the continent but also one of the worst road safety records, in part due to reckless driving and unroadworthy vehicles.

Privately owned minibus taxis are the main mode of transport for millions of working-class South Africans.

Many parents have to rely on private minibuses to get their children to school.

No chance for criminality, Rivers police warn

The Rivers State Police Command has stated it will not tolerate any act of criminality during the hunger protest scheduled for August 1-10 against economic hardship.

The police also urged protesters to act lawfully and refrain from actions that could compromise public safety or infringe on the rights of others.

The command’s spokesperson, Grace Iringe-Koko, issued the warning in a statement in Port Harcourt, the state capital, on Wednesday.

The statement reads, “The Rivers State Police Command has been closely monitoring the events surrounding the planned nationwide protests scheduled for August 1, 2024, and is prepared to act professionally in maintaining law and order during this period.

“The command acknowledges the constitutional right of citizens to gather and protest peacefully. However, we are wary of the potential for mischief-makers to exploit the opportunity of these planned protests to create chaos and civil unrest.

“The command commends those who have opted for alternate, lawful means of resolving the issues raised by the organisers, recognising the possibility of hoodlums hijacking the protests.”

The state police command, therefore, urged the organisers and protesters “to conduct themselves in a manner that does not compromise public safety and security or infringe on the rights of others,” adding that it will “firmly uphold the law and fulfil our constitutional duty to maintain order.”

Iringe-Koko further noted that the command would join forces with other security agencies in the state to “ensure that there is no breakdown of law and order before, during, and after the protests.”

“We have put in place measures to ensure a seamless operation, including the sensitisation and training of our officers, enhanced surveillance, improved patrol intensity, and the deployment of tactical units for crowd control, among other strategies.

“The command reiterates our commitment to respecting the rights of peaceful protesters and calls on the organisers to ensure that the protests remain lawful and orderly. We also charge everyone to act in the spirit of patriotism and civic responsibility.

“We urge all citizens to cooperate with the police and exercise their rights responsibly,” the statement read.

The command also warned that it would not “hesitate to take appropriate action to prevent any unlawful act or disruption to public order.”

The Lagos State Police Command has confirmed the death of Justice Offili-Ajumogobia’s daughter, Chukwu.
Chukwu’s father, Mr. Soboma Ajumogobia, is the younger brother of Odein Ajumogobia, a former Minister of State for Petroleum Resources.
The command’s spokesman, Benjamin Hundeyin, told journalists that three domestic staff had been arrested in connection with the incident.
He said the judge’s daughter was found dead on Wednesday.
Hundeyin said: “Three domestic staff have been arrested and handed over to the State Criminal Investigation Department, which has since taken over the investigation.
“Chukwu was found lifeless this morning (Wednesday) at about 6:45 a.m. at the entrance of her parents’ house on Bembe Street, Parkview Estate, Lagos.
“The detention of the three suspects was in line with a directive from the Lagos State Commissioner of Police, Mr. Adegoke Fayoade, for a thorough investigation of the death.”

“No president invested more in education than Tinubu”

The Senior Special Assistant to the President on Students’ Matters, Sunday Ashefon, disclosed on Wednesday that President Bola Tinubu deserves credit for his heavy investment in the education sector.

The former president of the National Association of Nigerian Students stated that it is on record that no past leader has achieved so many feats as Tinubu did within one year.

Ashefon said this at a town hall organised by NANS for students and members of the civil society organisation in Abuja on Wednesday.

The meeting was held to mobilise and enlighten youths on the danger of violent demonstrations ahead of tomorrow’s (Thursday) nationwide hunger protest.

According to the senior aide, the president has never hidden his intention to empower and make the Nigerian youths thrive long before he took over the mantle of leadership.

He said, “If there is someone who has been in the street and in the trenches who knows where the shoe pinches, it has been Asiwaju Bola Tinubu. I can say anywhere that he is a president who opens doors for young ones to thrive. I stand before you today to say that even in this government, he has given opportunities for young ones to be ministers.

“As a senior special adviser to this government, as a former president of the National Association of Nigerian Students in 2014/15 under ex-President Goodluck Jonathan and as a former president of the National Association of Nigerian Students in 2020/21 under ex-President Muhammadu Buhari, I am bold to say and will say it unequivocally that no president has invested what Asiwaju has invested in education within one year.

“In their eight years, they have not achieved that much in the sector. I am not saying this because we are here. I must accept that on my part I have failed to an extent. And how is that? I have failed to leave my office and go into the streets, centres and campuses to tell the students all that this government has done within one year in office. “If you count those who are under 40s in this administration, they can’t be less than five.”

Ashefon cited the student loan scheme, removal of university lecturers from the Integrated Personnel and Payroll Information among others as some of Tinubu’s impacts in the education sector.

In a similar event, former Bayelsa governorship candidate of the Labour Party in the last election, Udengs Eradiri appealed for demonstrators to resist vandalising public assets and private properties ahead of Thursday’s planned protest.

The ex-NANS leader noted that the scar and destruction witnessed in the November 2020 EndSARS demonstration is still fresh in the minds of Nigerians.

He said, “I think what we should be discussing is how to support this government to succeed. That is what young people should be thinking. Look at what happened in Lagos during the EndSARS. Success became the enemy when the people protesting EndSARS resorted to burning businesses. We all saw the level of destruction.

“I just returned from Port Harcourt today and I can tell you the Niger Delta youths are mobilising. We are also mobilising because we know those of us who didn’t want this protest to happen are fewer than those who want it to go on. But let’s manage it to a point where it does not destroy our future. That was what they did in Lagos.

“Look at the destruction in Lagos where they burned buses and vehicles some years ago. At the end of the day, we don’t have enough buses to move around. I think we should give this government a chance. For the first time, we have a president who is dealing with so many issues. Every issue raised on social media, this president is doing it.”

Tinubu, bank chiefs meet over windfall tax

President Bola Tinubu on Wednesday held closed-door talks with representatives of leaders of Nigeria’s commercial banking sector at the State House, Abuja, over the recently imposed Windfall Tax.

The Minister of Finance and Coordinating Minister of the Economy, Wale Edun, led the team, including the United Bank for Africa Chairman, Mr. Tony Elumelu, and the Group Chief Executive Officer of the First City Monument Bank, Ladi Balogun.

Edun, who briefed State House correspondents afterwards, said attendees discussed the banking sector’s role in promoting economic growth.

He said the Chairman of the Federal Inland Revenue Service, Mr Zacch Adedeji, explained the government’s plan to simplify the tax regime by taxing only profits and allowing companies’ capital to grow.

In mid-July, President Tinubu introduced a one-time windfall tax aimed at the substantial foreign exchange gains reported by banks in 2023.

He proposed this tax as part of an amendment to the 2023 Finance Act, seeking to generate additional revenue for crucial infrastructure, education, and healthcare projects under his Renewed Hope Agenda.

Windfall tax specifically targets the significant profits banks made due to the naira’s devaluation in 2023.

However, the proposal has not been without controversy. Moody’s Investors Service and other analysts have raised concerns about the potential negative impact on the banking sector.

They argue that the levy could significantly reduce profits available to banks to cover problem loans and maintain regulatory capital, posing a risk to the financial stability of banks already operating close to regulatory thresholds.

Nonetheless, the Senate recently passed the amendment bill, which includes increasing the windfall levy from the initially proposed 50 per cent to 70 per cent. It also extended the tax’s applicability from the end of 2023 to all profits from FX transactions through 2025.

Critics have warned that this retroactive dimension may lead to legal challenges and potentially discourage future investments, with some arguing that the tax burden may eventually be transferred to bank customers.

But Edun said, “As we know, the banking system has enjoyed some of what we’ll call windfall or unearned profits and in the interest of distributing wealth across the Nigerian society, the government has stepped in to take some of that wealth on behalf of Nigerians.

“We know at this time that the banking system is raising money. They’re selling shares, giving people the opportunity to participate in their wealth, and that includes foreign investors.

“So it’s against that background that Mr. Elumelu and Mr. Balogun wanted some clarifications, particularly on the windfall levy that has just been passed by the National Assembly.”

The minister said the FIRS Chairman, Adedeji, gave insight into how President Tinubu hopes to simplify the tax regime to “make it more efficient and less costly for people to even file their taxes.”

He said the reform will “focus on the wealth that is created, not to focus on the companies that maybe are not doing so well, or to focus on their capital, but to leave their capital alone to grow and make sure that the emphasis is on taxing and levying only the returns, only the profits.”

On their part, the bankers assured Tinubu of their compliance with the windfall levy, which, they said, is intended to transmit the administration’s reform agenda to the investment community and democratise prosperity and alleviate poverty.

UBA Chief, Elumelu, reasoned that mutual prosperity is vital to sustaining the system. He said where businesses thrive, jobs are created, and foreign and local investors benefit, leading to a prosperous society.

“We believe in prosperity, in creating jobs and employment for our people, in democratising prosperity, and in ensuring that Nigerians have access to a good life. So today, we spoke about the Windfall Tax. We support the government.

“We believe that where extraordinary income has made a part of, it should go towards helping to alleviate poverty in the country, which is what the government intends to do.

“We support that, and we just believe that we should ensure that no one segment suffers, that the government is able to continue to create jobs, and that businesses are also able to do well because we need mutual prosperity,” he said.

The FCMB Chief, Balogun, said he is confident that the Tinubu administration will continue to support all stakeholders by promoting growth and investment.

He emphasised the importance of aligning the banking sector and investment community with the government’s reform agenda.

Balogun said, “The purpose of the meeting was to ensure that this government’s reform agenda is well transmitted to not only the banking sector but also the investment community. We sought to ensure that we were all on the same page. I believe we are in the banks and the government.

“We also sought to ensure that we are also playing our role as a banking system and as an industry to channel back some of the gains we have made into the general economy. Now, we believe that this government and this administration are very much pro-investment and pro-growth, and they demonstrated that by listening to the concerns of the industry.

“We believe that what we are seeing is a government that will continue to support all stakeholders in this economy and promote economic growth. I believe that was the strongest message that came out today.”

The leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, has expressed pain over the deaths of Ohanaeze President-General, Emmanuel Iwuanyanwu, former Minister Ogbonnaya Onu, Senator Ifeanyi Uba, and Onyeka Onwenu.
Kanu called for prayers to avert too many deaths in Igbo land.
The IPOB leader also cautioned against speaking ill about Iwuanyanwu, Onu, Uba, and Onwenu because it’s against Igbo tradition.
Kanu disclosed this during his routine meeting with his legal team at the Department of State Services facility in Abuja.
Making Kanu’s remark public, his lead counsel, Aloy Ejimakor, said: “Today, Mazi Nnamdi Kanu directed me to convey his heartfelt sympathies to the families of Chief Emmanuel Iwuanyanwu, Dr Ogbonnaya Onu, Senator Ifeanyi Uba and Dame Onyeka Onwenu.
“MNK is pained at their demise and as he mourns, he sends his comfort to Ndigbo and requests that none should speak ill of the departed, as such is repugnant to Igbo traditions.
“He sees these deaths to be too many in so short a time and calls for prayers to avert too many deaths from the land.
“Onyeka Onwenu in particular was very close to Onyendu, who found her private advice to be invaluable. MNK recalls that Onyeka was a firm believer in freedom and that she lived a fulfilled life that guaranteed her eternal rest in heaven.”
