Appeal court affirms Uba Sani’s victory as Senator

0

Court of Appeal sitting in Kaduna on Monday affirmed Uba Sani as duly elected Senator for Kaduna Senatorial District in the February 23 national assembly election.

People’s Democratic Party (PDP) Senatorial Candidate in the election, Mr. Lawal Usman had dragged sitting Senator to the Appellate court, following the earlier ruling of the election petition tribunal in favour of Uba Sani.

Reading the 20 minutes judgement at the Appeal Court Kaduna on Monday, Justice Adefope O. Okojie said, the court upheld the earlier decision of the tribunal.

Explaining the appeal court judgement outside the court room, lead counsel to Uba Sani, Frank Ikpe said, all the three grounds in which court case was initiated against his client were without sufficient evidence.

According to him, “today, the court of appeal upheld the judgement of the local tribunal on three issues. The first was whether Uba Sani was qualified to contest being a political officeholder.

“The tribunal held that the document tendered by the appellant did not comply with relevance evidence act being an internet downloaded document. It must comply with relevant provision of Chapter of 82 evidence act.

“So the tribunal held that since it didn’t comply with that section, Uba Sani was qualified to contest. Today, the court of appeal has affirmed that decision.
“The second issue was that whether there is electoral malpractice in some local governments and the court held that there was no sufficient evidence to proof that INEC did not conduct the election in compliance with the guidelines of the electoral act. The court of appeal today ascend that decision.

“The third issue was non-compliance with relevant provisions. All the three were resolved in favour of Uba Sani. I am of the firm believe that, both the trial tribunal and the court of appeal did substantial justice in upholding the tenet of our democracy, they upheld the tenet of the rule of law affirming Uba Sani as duly elected senatorial candidate for Kaduna Central. In this regard, I believe Uba Sani will now be given the opportunity to represent his people without distraction,” he said.

He continued, “though the N100, 000 was not enough because we have been in court since March, that is seven months now. We thought court would have awarded more. The amount was to cover the expenses but I don’t know what N100, 000 will do. Nevertheless, we accepted it,” he added.

Reacting to the judgement, one of the Counsels in the legal team of Uba Sani, Sule Shuaibu said, “what the judgement simply means is that, justice is served the way it should be seen served. We are grateful to Almighty God.

“We have seen the light at the end of the tunnel. You don’t have to be a lawyer to know that from what has transpired, Uba Sani, who was popularly elected by the people and whose election was challenged in court, we knew he would be victorious. He was victorious at the tribunal and the tribunal spoke in unison.

“That unanimous judgement was appealed against and when we came to court of appeal, we were confident that, that unanimous judgement would be upheld and today, we have seen it.

“The judiciary has spoken. Politicians should learn to accept defeat and congratulate the opponent. In every contest, there must be a winner and there must be a loser,” he said.

2023: Afenifere accuses Ango Abdullahi of plots to break Nigeria

0

Yoruba socio-cultural organisation Afenifere Renewal Group (ARG), through its National Publicity Secretary, Yinka Odumakin, has said that a one-time Vice Chancellor of the Ahmadu Bello University (ABU), Zaria and Chairman, Northern Elders Forum (NEF), Prof. Ango Abdullahi’s stance that the region will rule Nigeria for the next century if it so wishes is capable of breaking the country.

Abdullahi had said that the region would support only candidate from the North in the race for President Muhammadu Buhari’s successor in 2023, adding that  zoning has no place or ground in the constitution of the country.

Odumakin in an exclusive interview with Sunday Telegraph said:  “If they think they can do whatever they like in Nigeria, they are only deluding themselves. No one will take that from them. Ango Abdullahi and Junaid Muhammed want to break this country by their comments. But we are committed to the Unity of this country. What we are saying is that we should restructure Nigeria and let everybody hold on to his resources and develop according to his pace. But that somebody will be dictating to us from Abuja, we will not allow it.

“2023 is not our main concern. What we want is the restructuring of Nigeria and let each federating unit rule his own area and let us contribute to the centre. 2023, 2027, 2031, nothing good will come out if we do not restructure Nigeria.”

Speaking in the same vein, the Apex Igbo socio-cultural organisation, Ohanaeze Ndigbo, through its National Assistant Publicity Secretary, Mazi Chuks Ibegbu, described the Northern elder as an agent of hate speech, who, being at the twilight of his life, should be a good model to Northern youths instead of  an agent of confusion.

Ibegbu said he was happy that Abdullahi was not speaking for the North, noting that there are fair-minded Northerners who are already rooting for the Igbo to produce the next president of Nigeria as a matter of justice and equity.

While deploring those trying to distract the present administrations at state and federal levels with the politics of 2023, which he said was still far away, he called on all the political parties to zone their presidential tickets to South East for the sake of fairness and equity.

He said: “Does Ango Abdullahi think he will live till next year? How can somebody play God? Is he God, does he know how long he will live on earth?

“Number two, he claims that the North has the population; he should stop saying that rubbish. There has not been any credible census in Nigeria to prove the population of any part of Nigeria, so all these assumptions are fake and bogus.

“Thirdly, I’m happy he is not speaking for the North because in the North, there are so many credible people and a few other Northerners have said that it is the turn of the Igbo. So, he is just self-acclaimed, he is not speaking for the North, he is speaking for himself, Ango Abdullahi.

“He is a merchant of hate speech, he is known for circulating, even at his age now, instead of being a role model for Northern youths, he is an agent of darkness. At his age instead of mentoring young people, he is causing confusion everywhere, making some provocative and disruptive statements.

“I believe he is not speaking the mind of Northerners, he is speaking his own, mind and people should discontinuance him.

“In the interest of justice and equity, I’m calling on all political parties to zone their presidency to South East when the time comes. But the time is so far off, I don’t know why people should be talking about 2023 when nobody is even sure of living the next day.

“They should not distract the present government and governors at all level with 2023 politics. When the time comes, equity and justice should be there.”

Also lending credence to it, the Movement for Actualisation of the State of Biafra (MASSOB) said the former university administrator is testing the waters to know how other sections of the country would react

“We know that Ango Abdullahi has suddenly become the systematic mouthpiece of the Fulani cabals as he would always disclose the true plot of the Fulani cabal and test the waters for them to know how Nigerians will react,” the group said.

Human Rights Commission calls for closure of detention centres nationwide

0

The National Human Rights Commission (NHRC) has expressed serious concern over the proliferation of illegal detention centres across the country saying that such centres must be closed to save their victims from further torture, inhuman and degrading treatments.

Executive Secretary of the Commission, Tony Ojukwu Esq who stated this in Abuja while reacting to the discovery of some illegal detention centres in some parts of the country , regretted that such centres by their atrocious activities have further expanded the frontiers of human violations in the country.

The country he said has in the last few weeks been inundated with reports of brazen abductions, particularly involving minors and youths who are unjustifiably subjected to various forms of inhuman and degrading treatment by their adductors.

According to Ojukwu, acts of torture and all forms of inhuman and degrading treatment under whatever guise are clearly illegal, constitute human rights violations under the 1999 constitution of the FRN as amended as well as the Convention Against Torture (CAT) and other International treaties to which Nigeria is a signatory. Furthermore, the Anti Torture Act of 2017 signed into law by President Buhari clearly outlaws and abhors acts of torture ,inhuman and degrading treatment and makes them punishable with imprisonment.

Ojukwu who was deeply concerned about the spate of abduction particularly among children and youths stated that the reported 300 inmates uncovered by the Nigerian Police in Daura, Katsina state, the children abducted from Kano as well as the two Torture centers uncovered in Kaduna are incidents among other similar cases across the country. These constitute grave human rights violations which must be thoroughly investigated and the culprits brought to book.

Meanwhile, the Executive Secretary has directed the Commission’s State Coordinators in the North West to carry out in-depth investigations into the alleged illegal detention centres including the case of the abducted children in Kano in line with the Commission’s mandate. “This will enable the Commission ascertain the various aspects of human rights violations perpetrated by the operators of the so called educational and rehabilitation centers preparatory to ensuring their prosecution and punishment in line with the law”, Ojukwu added.

Ojukwu frowned at the idea of abducting and dumping people, including children at unapproved centres in the name of rehabilitation saying that any form of training or education that is not approved and monitored by the relevant authorities’ must not be allowed to operate.

The Executive Secretary called on the Nigerian Police, Nigerian Security and Civil Defense Corps (NSCDC) and other relevant law enforcement agencies operating at the federal and state government levels to be more vigilant and fish out the perpetrators of these heinous crimes and ensure that they are diligently prosecuted in accordance with the law.

He said that the Commission will scale up its advocacy campaigns to sensitize people on the dangers of sending their children, ward or relations to illegal detention centres for the purposes of ‘rehabilitation.’

The Commission urged the Ministries of Education, Social Services and all other agencies responsible for the approval of the centers in all the states to recall all the approvals for the running of these centers and re-certify them after thorough inspection and monitoring of their activities.

The Commission further noted that henceforth, all persons with mental problem are to be admitted and treated in psychiatric hospitals and not in rehabilitation homes as any violators will be held accountable for human rights violation of the victims.
