How troops thwarted attack on Yobe gov’s convoy in Borno – DHQ

According to the Defence Headquarters, Yobe Governor’s convoy along the Maiduguri-Damaturu route was the target of a terrorist attempt on Saturday that was thwarted by soldiers of the 29 Task Force Brigade.

The two vehicles involved in the incident were also recovered by the troops, according to a statement released on Monday in Abuja by Maj.-Gen. Edward Buba, Director of Defence Media Operations.According to him, the conditions of the one DSS agent hurt in the attack, four police escorts, and the military truck driver were all stable.

He claimed that immediately after being taken to the Specialists Hospital Damaturu, one of the police escorts who had been hurt had passed away.

“To find the terrorists who carried out the heinous act, reinforcements from 29 Task Force Brigade, under the command of the Brigade Commander, are conducting battle patrols in the region.

The military MRAP and the civilian escort car, both of which had bullets fired at their tires during the incident, were the two cars involved in the collision. Both vehicles have now been safely returned to the military base in Benisheikh.

He declared, “Operations to find and eliminate the terrorists who carried out the attack are still underway.”

The Nigerian News Agency (NAN) recalls that on Saturday, approximately 6 kilometers from Benesheikh town, terrorists attacked the governor’s convoy as it was making its way back to Damaturu from Maiduguri.

When the caravan was ambushed, the governor was not present.

Femi Falana, a human rights activist and Senior Advocate of Nigeria (SAN), has requested a review of the Appeal Court’s rulings, which resulted in the removal of Governors Abba Yusuf of Kano State and Caleb Mutfwang of Plateau State.

During an interview on Sunday Politics on Channels Television, Falana made this call and harshly criticized the Independent National Electoral Commission (INEC) for failing to hold legitimate elections in Nigeria.

“The votes cast by Nigerians ought not to be invalidated by the judiciary due to the purported incompetence of the electoral umpire, who ought not to have approved candidates nominated by political parties without holding primary elections,” he said.

“The failure of INEC officials to stamp ballot sheets should not result in the court invalidating thousands of votes.”
He said that elections have to be finished before the start of any new government in the nation.

“Shaming voters for election officials’ errors is a very risky legal strategy. It is being claimed that 165,000 ballots were cast in error and are thus invalid since some electoral officials neglected to stamp them, Falana stated.

“I sincerely hope that the Supreme Court will finally put an end to these pointless disputes regarding INEC officials’ failure to stamp ballots, despite their not being advised to face any consequences.

“Therefore, a review of these judgements will be necessary.”
Three governors who were all affiliated with opposition parties and whom INEC had declared the winners of the March 2023 election have already been removed by the Appeal Court.

On Friday, the All Progressives Congress (APC) candidate Nasir Gawuna defeated Yusuf of the New Nigerian Peoples Party (NNPP) in the Kano governorship election petition tribunal, and the ruling was upheld by the court of appeals in Abuja.
In its ruling, a three-judge Appeal court panel declared that the NNPP had violated the constitution by supporting Yusuf, a non-member of the party, as its candidate for governor of Kano.

After deeming the result inconclusive, the appeal court in Zamfara state fired Governor Dauda Lawal, who ran on the Peoples Democratic Party (PDP) platform.

The court then ordered INEC to hold new elections in three of Zamfara state’s local government areas.

The appellate court dismissed Mutfwang of the PDP on Sunday and directed INEC to provide Nentawe Goshwe of the APC a Certificate of Return.

Police warn against protest over Kano gov’s sacking

The Kano State Police Command issued a warning on Monday against protesting in any way after the Court of Appeal’s decision to uphold the removal of Abba Yusuf as the state governor.

In a news release, the command’s spokesperson, SP Abdullah Kiyawa, stated that security personnel have reliable evidence that certain people are organizing to oppose the court’s decision.

In a statement, it was stated that the call had been made in response to reliable information that the command had access to. This information disclosed certain political party supporters’ plans to mobilize people through non-traditional media channels and take to the streets to demonstrate against the Friday, November 17, 2023, ruling of the Kano State Governorship Appeal Court.

“The information indicated that the demonstrators’ goal is to shut down the state, a move that is likely to spark violence.” With this in mind, the state’s police command warned citizens to exercise additional caution because anyone planning to stage a protest or parade must follow all legal requirements.

The state police command invited the leaders of the New Nigeria Peoples Party and the All Progressives Congress to a peace pact signing on Thursday, November 16, 2023, prior to the court ruling.

Regardless of the verdict, the peace accord’s goal was to sustain unity and guarantee that the state’s political climate remained tranquil.
Additionally, the leaders of the two political parties pledged that no groups of people gathering for political purposes would be permitted anywhere, under any pretense, and that their followers would not participate in any kind of mass gathering that would encourage the planning of violent processions, demonstrations, or celebrations that might incite violent reactions.

Additionally, they pledged to refrain from allowing any of their members to make careless remarks that would heighten political unrest or jeopardize the safety of the legal system and security protocols.

Additionally, they pledged that their parties would back all measures taken by the security apparatus to uphold law and order and that anyone or any group of people found to be directly or indirectly disturbing the peace prior to, during, or following the ruling of the appeals court would be subject to the full force of the law.

Following the peace agreement, joint security forces were mobilized and sent to key locations to maintain peace and order throughout the state. State Commissioner of Police Mohammed Gumel urged all citizens to remain calm and refrain from any unlawful gatherings, protests, or parades that might incite violence.

He proclaimed, “Again, anyone attempting to disturb the tranquility within the state will be apprehended and confronted with the fury of the law.”

While thanking the state’s citizens for their cooperation, understanding, and support, the CP advised them to report any unusual person movement without delay.

Nigeria resumes passport services in US after Internet hitch

The United States of America’s passport manufacturing situation has been resolved by the Federal Government, and passport services have been restored at all three Missions.

A public notice published in the Nigerian Embassy in Washington, DC, states that all passport applicants who were previously booked for biometrics should visit the Mission on Monday.

This is to notify all passport applicants who were scheduled for biometric capture from Monday, November 13 to Thursday, November 16, that their appointments have been postponed, according to the message.

The new date of the event is Wednesday, November 22, 2023, instead of Monday, November 20. On any of the days, the impacted applicants are welcome to visit the Embassy.
We apologize for any trouble this may have caused. The Embassy’s internet outage is the reason for the timetable modification.

This news was confirmed on Sunday by an Embassy source who told the News Agency of Nigeria in New York that the issue had been fixed over the weekend.

On Monday, Osun State judicial employees staged a protest outside the High Court building, which houses the state chief judge’s office, over allegations of member suspension and unpaid wardrobe allowance.

Late on Sunday night, Edison Ehie, the factional Speaker of the Rivers State House of Assembly, is said to have averted assassination.

Hon. Ehie is devoted to Siminalaye Fubara, the state governor.

According to a statement signed by Ken Uchendu, Ehie’s legislative assistant, the accused assailants comprised some police officers and armed thugs under the command of a top police official in the State.

According to the statement, at approximately 11 p.m. on Sunday, November 19, 2023, a group of armed thugs and rogue police officers attacked the private residence of the Speaker of the Rivers State House of Assembly, Rt. Hon. Barr. Edison Ogerenye Ehie, DSSRS, fully armed with the intention of killing Mr. Speaker and his family. The group was led by one SP. Irikefe London Owen, a superintendent of police attached to the CTU B 3 RSV and CSP Salihu Masalachi.

APC, PDP in war of words after Appeal Court fires third opposition gov

Following the dismissal of Plateau State Governor Caleb Mutfwang by the Court of Appeal in Abuja, the Peoples Democratic Party (PDP) and the All Progressives Congress (APC) engaged in a heated dispute on Sunday.

The Independent National Electoral Commission (INEC) was directed by a three-member panel of the Court of Appeal, presided over by Justice Elphreda Williams-Dawodu, to withdraw the certificate of return granted to Mutfwang and provide a new one to APC candidate Nentawe Goshwe, who the court recognised as the legitimate victor of the March 18 governorship election.

In the span of three days, Mutfwang became the third opposition governor to be dismissed by the Court of Appeal.

Last Thursday, the appellate court nullified the election of another PDP Governor, Dauda Lawal of Zamfara State, declaring that the governorship election in the state was inconclusive.

The next day, Abba Kabir Yusuf, the governor of Kano State and member of the New Nigeria Peoples Party, had his election as governor declared illegitimate by the same court.

The PDP’s deputy legal adviser, Okechukwu Osuoha, reacting to the developments in a statement on Sunday, expressed concern about the repeated legal setbacks experienced by its governors and MPs, stating that the latest rulings from the courts did not follow the law.

Osuoha, who said he did not have a copy of the judgment yet explained that there were three grounds for the election petition matter.

He said, “One is that when somebody is claiming that he won an election with the most number of valid votes, the person will have to prove it. The second is malpractice; the person who alleged would have to prove it.

“Then qualification; whether the person was qualified or not. So these are the grounds. It is in the public domain that Nigerians and PDP are not too comfortable with judgment from the courts.

“In the ruling party, APC, impunity is so much. They try to influence some of these institutions to force their party on Nigerians. That is the ugly side of it.”

However, APC Director of Publicity Bala Ibrahim also in a statement retorted that those accusing the APC and the Presidency of attempting to create a one-party state in Nigeria were ignorant of the workings of the legal system.

He said, “Nobody is turning Nigeria into a one-party state. These are some of the baseless allegations coming from people who don’t know how the system works. The judiciary is independent.

“There is just no way any arm or the executive can intimidate or make the judiciary act against its own wish. People are not applying their logic sensibly.

“There are areas where the ruling party has lost and we have castigated, lambasted or cast aspersion on the judiciary. We know the judiciary may have their reason to take the decision against us.

“That is not to say people should think it is the executive that is manipulating the judiciary every time we win.

“People should learn to be good sportsmen. Where you lose today, you may win tomorrow. We should have confidence in the system, ourselves and democracy.

“As long as we continue to be selective in our assessment of the system, we will always get it wrong. We should allow the judiciary to work with the psyche of independence and continue to encourage the system to strengthen democracy. Let us not be judgmentally selective.”

Plateau gov’s removal: APC, PDP clash as A’Court sacks third opposition gov

On Sunday, following the dismissal of Governor Caleb Mutfwang of Plateau State by the Court of Appeal sitting in Abuja, members of the Peoples Democratic Party and the All Progressives Congress got into a fight with each other.

A three-member panel of the Court of Appeal led by Justice Elphreda Williams-Dawodu issued a judgment on Sunday ordering the Independent National Electoral Commission to withdraw the certificate of return that had been issued to Mutfwang and issue a new one to Nentawe Goshwe of the APC. The court had previously declared Goshwe to be the legitimate winner of the March 18 governorship election.

Within a span of three days, the Court of Appeal removed Mutfwang as governor, making him the third opposition governor to be removed from office.

The appeals court ruled on Thursday of last week that the election for governor of Zamfara State, which had been won by another member of the People’s Democratic Party (PDP), Dauda Lawal, should be overturned because it was inconclusive.

The election of Abba Kabir Yusuf, candidate for governor of Kano State and member of the New Nigeria Peoples Party, was declared unlawful by the same court the next day.

Okechukwu Osuoha, the Deputy Legal Adviser for the People’s Democratic Party, has stated that the recent court rulings are not in line with the law. This statement was made in response to the string of defeats that the PDP’s governors and parliamentarians have had in the courts.

However, the Director of Publicity for the All Progressives Congress (APC), Bala Ibrahim, retorted that the people who were accusing both the APC and the Presidency of attempting to turn Nigeria into a one-party state were people who did not understand how the legal process worked.

In the election for governor held on March 18, the candidate of the People’s Democratic Party (PDP), Mutfwang, received 525,299 votes, while the nominee of the APC, Goshwe, received 481,370 votes.

At the tribunal, Goshwe contested Mutfwang’s victory by arguing that the governor had not been legitimately nominated and sponsored by his party. He was successful in this challenge.

In addition to that, he stated that the election did not comply with the Electoral Act in any way.

In spite of the fact that his petition had been denied by the Governorship Election Petition Tribunal on the grounds that it lacked substance, Goshwe appealed the decision.

The conclusion that had been made by the panel was, however, overturned by Justice Williams-Dawodu in the lead judgment.

Because the PDP did not conduct valid state, local government, and ward congresses as ordered by a High Court of Plateau State and it did not have any structure as of the time of the election, the judge decided that Mutfwang was not validly sponsored by the PDP and that he was not qualified to have competed in the election. In addition, the judge ruled that Mutfwang was not qualified to have competed in the election.

She based her decision on section 177 of the Constitution and maintained that the PDP did not legitimately support the candidate for governor during the election.

She came to the conclusion that the political party had disobeyed a court order that directed it to hold a legitimate congress in each of the state’s 17 Local Government Areas.

Williams-Dawodu stated that there was no proof that the People’s Democratic Party (PDP) cooperated with an existing order from the High Court, which instructed it to convene the party congress prior to its sponsorship of the governorship and other candidates. Williams-Dawodu stated that there was no evidence that the PDP complied with the order.

In contrast to the findings of the tribunal, which stated that the appellant lacked the legal standing to question the validity of the respondent, the court decided that the issue of qualification is relevant both before and after an election and ruled that it should be considered in both contexts.

In addition to this, the court said that according to subsection 134 of the Electoral Act, it is the sole right of a political party to sponsor its candidate provided that the party has satisfied all of the procedures necessary to do so.

After that, she gave the directive to INEC to take back the certificate of return that had been given to the governor and to issue a new certificate of return to the Goshwe.

Williams-Dawodu stated that the ruling of the Tribunal that validated Governor Caleb’s election must be overturned. The appeal has been granted in this instance. The dispute has been settled in a manner that is favorable to the appellants.”

PDP kicks it in.

Speaking about the decision, the Deputy PDP Legal Adviser, Osuoha, indicated that the election petition issue was based on three different grounds, despite the fact that he claimed he did not have a copy of the judgment at the time of his comments.

He made the following statement: “One is that when anybody is claiming that he won an election with the largest number of genuine votes, the individual will be required to show it. The second possibility is unethical behavior, in which case the accuser would be responsible for providing evidence.

“Following that, qualification, specifically whether or not the person in question was qualified. So these are the arguments that support it. It is common knowledge that the people of Nigeria and the PDP do not feel particularly at ease with the ruling handed down by the courts.

“Impunity is rife inside the party that is now in power, the APC. They make an effort to exert their influence on a few of these institutions in order to impose their party on the Nigerian people. That is the unattractive aspect of it.

Osuoha emphasized that “Most of the recent judgments are not really in tandem with the law,” which was his main point. The majority of the time, the justices will rely on legal technicalities.

“The court now portrays itself as a court of technicalities and not a court of justice, and this is not too palatable for our system, our country, or our democracy.”

The attorney pointed out that there is still time for the party and Mutfwang to file an appeal against the verdict.

Because the general public has a high regard for the judicial system, it is imperative that people continue to have faith in it.

“The majority of Nigeria’s institutions are weak, which is the primary cause of the country’s current woes. In my opinion, our judicial system and our Supreme Court should be recognized as exceptional. He admonished the judicial system to make decisions without favoring either party.

Additionally, the Deputy National Youth Leader of the PDP, Timothy Osadolor, made the accusation that “the highest bidders were getting favorable rulings.”

Osadolor issued a stern warning, saying, “The clock is ticking, and the patience of our people is running thin.” Our judges should honor the heroes of the past or become the heroes of today by recusing themselves from making decisions and declarations that are influenced by money.

We are prepared to put up a fight against those who seek to impose the APC on the Nigerian people.

Misconduct on the judicial bench

Meanwhile, the National Auditor of the New Nigerian People’s Party, Ladipo Johnson, referred to the judgment as “judicial rascality that is unfolding.” He said this in response to the verdict.

Johnson stated in an interview with one of our correspondents that the APC still has a long way to go before it can successfully impose itself on the Nigerian people.

He made the following statement: “The bottom line is that the judiciary have put themselves on trial because of some inconsistent principle that we are seeing.” The most recent decisions handed down by the judicial system are giving a lot of people in our country serious cause for concern.

In response to the question of whether or not this is an intentional attempt to impose the APC on the Nigerian people, he stated that “even if this is not an attempt to impose the APC on the Nigerian people, it will have the effect.” Because the PDP holds power in so many states, it will be difficult for them to impose APC on the Nigerian people. Therefore, it is a significant distance from it.”

According to the statement made by the NNPP National Auditor, “So there is judicial rascality going on.” Yes, I haven’t read the ruling, but based on what I’ve seen of the excerpt, there appears to be some kind of mischief being committed. The judicial system is no longer worthy of our confidence.

However, we are keeping our fingers crossed that the Supreme Court will provide some clarity on these matters and, if you will, follow its own precedent.

The leadership of the Labour Party has stated their fear that the administration of President Bola Tinubu may have been “using the judiciary to hound opposition parties and steal the mandate of the people.”

Yunusa Tanko, the chief spokesman for the LP Campaign Organisation, came to the conclusion that the judgments might have been spurred by some “vicious” persons in the executive arm of government who were using the judiciary as a tool to capture the states in response to the sacking of three opposition governors by the court. These individuals were using the judiciary as a tool to capture the states.

He stated, “As I mentioned previously, the particular group of people who are currently in charge are terrible politicians. To emphasize my point, I will use the word vicious once more.

“Steadily, we are beginning to observe states that have been entirely captured, which means that all of the institutions have already been purchased, intimidated, or blackmailed to do the bidding of the current political party and the government that is currently in power.

“There is absolutely no hanky-panky involved. They have made it abundantly plain what it is that they intend to accomplish, and they are putting our democracy in a position of power.

“It is now up to us to truly challenge these particular people in order to prevent them from taking us to the cleaners totally. And it doesn’t matter to them when, when, or how they do it as long as it works out in their favor. This is where the threat lies.

“Now that the electorates are aware that the mandate might be taken away from them, they are being deterred from going out to vote for politicians of their choosing. They have already taken command of the state’s administrative machinery.

“During the time that the PDP was in control of the government, we experienced something quite similar. “As long as we continue to take only some aspects of the system into consideration when evaluating it, we will never get it right. We ought to make it possible for the judicial system to operate in accordance with the mindset of independence and keep pushing for the system to become more democratic. Let us not pick and choose based on our preconceived notions.”

A hiccup for the time being

In his response to the verdict rendered by the court, Mutfwang characterized the defeat as a momentary setback that will not stop him from repositioning the state on the path toward unity, peace, and advancement.

He had asked his legal team to file an appeal with the Supreme Court, so he was very optimistic that the mandate that had been “overwhelmingly given to him by the people of Plateau State would be restored.”

The minister expressed his confidence that Nentawe’s victory will stand the test of time, despite the fact that the defeated candidate of the PDP and the PDP itself had the constitutional right to pursue any and all legal options accessible to them.
