Nigeria: 21 Nigerians Sue Akpabio, Abbas for ‘Arbitrarily’ NASS Budget Increase

Both Akpabio and Abbas are sued for themselves and all National Assembly members.

The Senate President, Godswill Akpabio, and House Speaker, Tajudeen Abbas, have been sued by SERAP and 20 concerned Nigerians “for unilaterally and arbitrarily increasing the allocation for lawmakers from N197 billion to N344 billion, their highest since the return of democracy in 1999.”

Both Akpabio and Abbas are sued for themselves and all National Assembly members.

The lawmakers increased their budget allocation from N197bn proposed by President Bola Tinubu to N344bn last month. N514bn from the 2024 budget will go to lawmakers. Lawmakers arbitrarily increased their budget from N169bn to N228bn in 2023.

The plaintiffs asked the Federal High Court, Abuja, “whether the lawmakers, in the exercise of their powers over appropriation/money bills, can unilaterally increase their own budget without the re-presentation of the budget by the Executive.”

The parties are asking the court for “a declaration that the National Assembly, in the exercise of its powers over appropriation/money bills, cannot unilaterally increase its own budget without the re-presentation of the budget by the President in line with section 81 of the Nigerian Constitution 1999 [as amended].”

The parties are asking the court for “a declaration that the action of the National Assembly, unilaterally increasing its own budget from N197 billion to N344 billion, without the re-presentation of the budget by the President is a breach of the democratic principles of separation of powers and checks and balances.”

They want “an order of perpetual injunction restraining and preventing the National Assembly from unilaterally increasing its own budget, in the exercise of its powers over all appropriation/money bills, without the re-presentation of such appropriation/money bills by the President in line with the Nigerian Constitution.”

The suit alleges that the plaintiffs: “Allowing the National Assembly to continue to unilaterally and arbitrarily increase its own budget would fundamentally undermine the letter and spirit of the Nigerian Constitution, public trust, and the rule of law.”

They are also claiming that “The arbitrary and self-serving increase by the lawmakers of their own allocation offends the Code of Conduct for Public Officers [Fifth Schedule Part 1] of the Nigerian Constitution, oath of office, and the democratic principles of separation of powers and checks and balances.”

According to them, “Unless the reliefs sought are granted, the National Assembly will continue to breach the provisions of the Nigerian Constitution and the rule of law, and at the expense of millions of Nigerians living in poverty.”

Kolawole Oluwadare and Andrew Nwankwo’s suit on behalf of SERAP and 20 concerned Nigerians stated: “Members of the National Assembly are public officers who have sworn the constitutional oath of office to perform their respective duties in the interest of Nigerian citizens.”

“The members of the National Assembly, by unilaterally and arbitrarily increasing their own budget in the Appropriation Bill 2024, without the re-presentation of the budget by the President has violated the Code of Conduct for Public Officers.”

“Paragraph 1 of the Code of Conduct for Public Officers which provides that ‘a public officer shall not put himself in a position where his personal interest conflicts with his duties and responsibilities.” ‘

“Members of the National Assembly have put their interest above the public interest and ‘well-being and prosperity of the Federal Republic of Nigeria’, contrary to their oath of office.”

“It is a necessary implication of the rule of law that, except where the law gives a discretion to a public functionary, he can only act in accordance with the law, as to do otherwise may enthrone arbitrariness.”

“The increase and insertion of line items in the Appropriation Bill 2024 by the National Assembly is not commensurate with the constitutional commitments to public services and goods; decreasing public revenues and increasing level of public debts, and the poor economic and social realities in Nigeria.”

On 29 November 2023, the President presented the N27.5 trillion Naira Appropriation Bill 2024 to the National Assembly. On December 30, 2023, the National Assembly passed the N28.7 Trillion Appropriation Bill 2024.”

“That while exercising its legislative powers, the 1st and 2nd Defendants increased the Appropriation Bill by N1.2 Trillion, wherein the 1st and 2nd Defendants unilaterally increased allocations made to the National Assembly in the Appropriation Bill 2024 presented by the President from N197,932,625,616 Billion Naira to N344.85 Billion.”

The ₦28.7 Trillion Appropriation Bill 2024 was signed into law by the President on January 1, 2024. The 2024 budget deficit is ₦9.18 Trillion.

“The Budget/Appropriation Act 2024 is yet to be gazetted as at the time of filing this suit and public access to the gazetted 2024 Budget/Appropriation Act is restricted.”

“The National Assembly after inserting new line items to the Appropriation Bill 2024 and altering the budgetary allocation to already inserted line items did not submit same to the President for re-presentation by the President before going ahead to present the Appropriation Bill to the President for assent.”

In addition, SERAP and 20 concerned Nigerians are seeking the following reliefs:

 

1. The National Assembly’s unilateral increase in its budget from 197 billion Naira to 344 billion Naira in the exercise of its powers over Appropriation Bill 2024 without the President’s re-presentation is a violation of section 81 of the Nigerian Constitution 1999 [as amended], the Code of Conduct for Public Officers [Fifth Schedule Part 1], and the Oath of Office [Seventh Schedule].

2. A COURT ORDER OF PERPETUAL INJUNCTION restraining and preventing the National Assembly from unilaterally increasing its budget in the exercise of its powers over all appropriation/money bills without the President re-presenting them in compliance with section 81 of the Nigerian Constitution 1999 [as amended] and democratic principles of separation of powers and checks and balances.

3. AN ORDER OF THE HONOURABLE COURT directing, compelling, and mandating the National Assembly, in the exercise of its powers over all appropriation/money bills, to comply with section 81 of the Nigerian Constitution 1999 [as amended] by sending such bills to the President for re-presentation before the National Assembly.

NERC approves 2024 DisCo CAPEX of N153.3bn

NERC approves 2024 DisCo CAPEX of N153.3bn

For the 11 Electricity Distribution Companies, the Federal Government (FG) through the Nigerian Electricity Regulatory Commission (NERC) has approved N153.2 million in CAPEX effective January 1, 2024.

The changes require DisCos to commit to service improvement programs that improve power supply, reduce Aggregate Technical, Commercial, and Collection losses (ATC&C), implement effective billing and payment structures, and improve customer metering.

After engaging with NERC to justify costs and tariffs, each DisCo received new CAPEX packages under the Performance Improvement Plans (PIP) in separate orders.
The Commission recently released the Multi-Year Tariff Order (MYTO) 2024, which shows DisCos’ approved CAPEX differs.

 

The largest amounts were approved for Eko Electricity Distribution Company (EKEDC), Ikeja DisCo, and Abuja Electricity Distribution Company (AEDC): N23 billion, N19 billion, and N18 billion.

 

The lowest award was N7 billion to Yola Electricity Distribution Company (YEDC).

 

In their service improvement investment programs, the allocated funds should help DisCos grow.

The Commission approved N6.25 billion for each DisCo to install 65,000 meters annually from the total funds, erasing estimated billing methods from their networks.

From 2023 to 2027, DisCos’ meter roll-out program is funded annually.

The Regulator also set DisCos’ Aggregate Technical, Commercial, and Collection (“ATC&C”) loss targets.

DisCos proposed a review to reset their new baseline ATC&C loss levels, the Order stated.

It said the approved ATC&C loss level is fair and reasonable given current operating conditions and comparable benchmarks within and outside NESI.

From 2024 to 2027, the Commission set a baseline ATC&C loss level of 25%, 20.6 percent, 16.97 percent, and 13.99 percent for AEDC.

“Plane crash that killed former Army Chief was not accident” says Former General

Former GOC of 1 Division of the Nigerian Army, retired Major General Danjuma Ali-Keffi, has expressed grave concerns about the air crash that killed former Chief of Army Staff Lt Gen Ibrahim Attahiru and 11 other senior military officers.

In an exclusive interview, Ali-Keffi claims that terror financiers are involved in the crash and urges President Bola Tinubu to investigate immediately.

Ali-Keffi, who questioned the official investigation, claims critical crash details were omitted.

He stressed that the full investigation report has not been released, increasing suspicion about the tragic incident.

The retired general credits Attahiru with developing Northern Nigeria’s anti-terrorism strategies.

Ali-Keffi says the late army chief exposed and neutralized terror financiers.

Ali-Keffi details the events leading up to the crash, questioning the abrupt changes in the scheduled trip, aircraft choice, and landing airport.

He disputes the official narrative by citing the aircraft’s descent in stormy weather, a delayed departure, and an ear-shattering explosion before the crash.

According to Ali-Keffi, “About 2100 hrs on Thursday 20 May 2021, I spoke on the phone with the Chief of Staff (COS) to the late COAS about their upcoming trip to Kaduna.

I discussed this with General Attahiru before. We concluded that the late COAS and entourage would arrive by flight at 1000 hrs the following day.

In order to make arrangements for the mosque where the COS would attend Jummu’at (Friday) prayers, I called the late COAS at 0630 hrs the following morning to confirm if their travel plan was as discussed the night before.

“The COS informed me of a plan change. After we finished speaking last night, they received a message that the late COAS was to attend a meeting at the Honourable Minister of Defence (HMOD) office or the Presidential Villa at about 1000 hrs on Friday, May 21, 2021, in person and not send a representative.

It should be noted that the late COAS visited Kaduna as part of his visit to Zaria for the Depot NA Passing Out Parade on Saturday, 22 May 2021.

“The CDS, HMOD, and presidency are informed before service chiefs leave Abuja.

Why was a meeting scheduled for about the same time the late COAS was to leave for Kaduna, and why was he not represented?

The COS informed me that they would leave the Flag House (official residence of the COAS) at about 1530 hrs (after the meeting and Jummu’ at prayers) for the airport due to the meeting.

They planned to arrive at the airport at 1600 hrs, board the plane at 1610–1615 hrs, and fly to Kaduna. At 1600 hrs, I was informed they had arrived at the Airport Presidential Wing. My convoy left the Stallion House (GOC residence) and arrived at the Air Force Base at 1615 hrs.

“The flight was delayed for over an hour and did not take off until 1730 hrs for reasons I don’t understand until today. I was informed that the aircraft assigned to transport the COAS and his entourage had issues and had to be changed, causing the delay.”

Ali-Keffi added, “Meanwhile, a meteorological alert warned of heavy rainfall and wind shear in Kaduna airspace. We saw the Kaduna cloud at the airport.

Indeed, the cloud was thick, indicating a massive storm. I questioned the flight. I told Air Commodores Iyamu and Ilo, who were with me to receive the COAS, my doubts.

I even suggested they notify Abuja of weather conditions to cancel the flight. I was informed that the aircraft was airborne at 1745 hrs. I wondered if the plane could land at the airport in such a heavy rainstorm.

Thus, I was not surprised when Air Commodore Ilo told me we had to go to the Civil (International Airport) because the NAF runway was too short to land the aircraft in the terrible weather. Due to heavy rainfall and shale, we drove slowly to the International Airport.

After arriving near the airport, the former GOC heard a thunderous sound, which I thought was thunder. I thought the plane was descending to land on the runway. When we turned the bend to enter the tarmac, I thought the plane had landed and was taxiing to the parking area.

I saw no planes on the runway. I frantically looked around and saw a fireball on the runway’s other side. The plane carrying General Attahiru! We left the cars, crossed the runway, and approached the burning plane. Firefighters extinguished the fire. We retreated for fear of cylinder explosions.

We found the bodies of the 10 plane passengers far from the wreckage. Apparently, their burning bodies were thrown from the plane before it crashed. I remember the aircraft being on a flat grassland.

There was no crater. This indicated a midair explosion. What caused the plane’s explosion? What does the Air Safety and Accident Investigation Bureau report say about the incident?

Ali-Keffi wondered, “Was the flight deliberately delayed to catch the rainstorm?” Did the plane explode midair due to sabotage? Did explosives cause the blast? Was a bomb planted in the plane or in a parcel a passenger carried?

On Monday, President Bola Tinubu celebrated former presidential aide Reno Omokri’s 50th birthday.

On Sunday night, President Tinubu praised the author and influencer “for his dutifulness in providing constructive opinions on national issues, regardless of his political disposition”.

Ajuri Ngelale, presidential spokesperson, said Mr. Omokri, a Peoples Democratic Party member, was former President Goodluck Jonathan’s Special Assistant on Digital Media from 2011 to 2015.

Mr. Omokri deserves many more years in good health to contribute to national development, says President Tinubu.
Prior to the 2023 elections, PDP member Mr. Omokri was a vocal critic of President Tinubu and the All Progressives Congress (APC).

Ex-special assistant on digital media to President Goodluck Jonathan’s political posturing has been intriguing in recent months.

As a PDP member and supporter of Atiku Abubakar, one of Nigeria’s leading opposition figures, Mr. Omokri appears to have warmed up to President Tinubu and his government, becoming one of their most vocal and effective defenders.

Tajudeen Aro, the Kwara State Publicity Secretary for the All Progressives Congress, discusses a variety of topics with TUNDE OYEKOLA, including the scandal surrounding the rice palliative that was purportedly supplied to National Assembly members.

During the first half of his second term, what was your impression of Governor AbdulRahman AbdulRazaq’s performance?

In his second tenure, the governor has shown some very encouraging and noteworthy results. He has been performing well, and government is a continuity. Work of the General Tunde Idiagbon Bridge at the Tanke area has accelerated as we speak. During his first term, a number of other initiatives were initiated, including the garment factory and road improvements in Ilorin and other parts of the state. When the people of the state elected him to a second term in office, they did not err. However, I want to implore our people to support the governor more so that he can function better. The governor has more goods in store for the state’s citizens, and he needs our encouragement and support to make progress.

The state’s residents have received food palliatives as part of the steps implemented after the federal government stopped providing gasoline subsidies. Do you believe that the impact of the evacuation on the people has been lessened by these palliatives?

 

In the best interests of the Nigerian people, the Federal Government removed the fuel subsidy. The federal and state governments devised a range of interim strategies to mitigate the impact of the discontinuation of the fuel subsidy. Sadly, because of our lack of sincerity and our shoddy planning and implementation from top to bottom, the anticipated improvement in people’s living situations is not felt despite our best efforts.

Regarding the palliative awards that the Kwara State Government has granted to the state’s citizens, what are your thoughts?

As the head of the Nigeria Governors’ Forum, our governor was the first to announce a number of interim measures for the state’s residents to lessen the impact of President Bola Tinubu’s announcement regarding the elimination of gasoline subsidies. These included giving people food aid, cutting the number of working days from five to three, and lowering the cost of maize for chicken producers.

The productive sector, especially farming, was the focus of government initiatives. Despite the greatest efforts of the distribution committee, the amount is insufficient and unsustainable given Nigerian factors like greed and selfishness. The government started giving the workers a N10,000 monthly stipend in addition to what it was already paying. I would want to make a plea to the government to step up efforts to address the paltry sum provided as palliative care to employees and pensioners.

The federal government reportedly approved the purchase of trailer loads of rice as a consolation for the elected federal lawmakers. Do you consider this information to be accurate?

Indeed, the accuracy of that assertion was demonstrated by a number of remarks made by federal officials and lawmakers. However, the fact that it was not delivered to individuals in the various constituencies and was not received by some parliamentarians does not imply otherwise. I want to implore the people to have patience with their political officials since the rice palliative will soon be available to them.

The nine lawmakers who were elected to the state assembly on the APC platform denied having received the trailer loads of rice that were to be given to their constituents. What are your thoughts on this?

Let’s give them the benefit of the doubt and ask them to be patient.

How should the federal and state governments address the problem of providing palliative care to the state’s citizens?

The government is aware of some methods that palliative care providers can use to reach the lowest levels of society. We have set up institutions and associations through which these palliatives can be administered. The most vulnerable persons can be found, as a last option, in churches and mosques. Through community associations, religious organizations, and other channels, these food goods and other commodities can be distributed.

The state government recently gave a single corporation three significant contracts: Kwara Hotels, Unity Road development, and a flyover along Unity Road. What is your opinion of this, and do you believe it to be true?

It is dependent upon the procedures and requirements included in the contract approval. The company may be granted several chances and opportunities to carry out these contracts, provided that these requirements are satisfied and there is no reason to question the organization’s competency or honesty. Thus, I don’t think there is anything wrong with the state government’s decision to award the three contracts to the same business.

The Federal Capital Territory Administration (FCTA) staff is thrilled with the recent reversal of a new permanent secretary who was allegedly posted to the administration.

The majority of senior staff members have praised President Bola Tinubu for listening to their grievances.

The FCT minister, Nyesom Wike, was also commended for his prompt involvement that resulted to the posting’s reversal, which they claimed was “uncalled for, unlawful, and inimical to the powers of the President who has already approved creation of the FCT Civil Service Commission.”

In an interview with some media in Abuja over the weekend, the employees operating under the auspices of the League of Retired and Serving FCTA Directors said this.

Oramosele gave voice to optimism for a better Federal Capital Territory (FCT) and Nigeria, stating: “It is clear that we are in for good times and better days, not just as staff members who are serving or have retired, but also as contractors handling Federal Government or FCTA projects in the FCT are happy because they are working and paying nonstop.”

“Despite the challenges, there is hope throughout the entire country because the ship’s captain is guiding it away from the storms and into calm waters, and we can see and feel hope.”

Remember that the Federation’s Head of Civil Service recently assigned Dr. Magdalene Ajani, the new Permanent Secretary, to the FCTA?

She was supposed to succeed Olusade Adesola, the Permanent Secretary in position at the moment, who is scheduled to retire on May 29, 2024.

The President’s recent approval of the FCT Civil Service Commission’s creation, which does not include the position, appears to have been the reason for the rejection protest that the FCT Administration officials conducted shortly after her assignment was made public.

A program called Build-A-Thon is scheduled to begin for 1,500 secondary school students by the Federal Ministry of Communications, Innovation, and Digital Economy.

150 schools from three different locations—Owerri, Maiduguri, and Abeokuta—will participate in the four-day event, according to a release. An ecosystem providing a range of learning possibilities, such as DIY boxes, technology laboratories, and skill-building seminars, is what the organizers described as a Build-A-Thon.

Delta APC accepts Supreme Court decision, congratulates Oborevwori

The Independent National Electoral Commission (INEC) had declared Francis Sheriff Oborevwori the winner of the March 18, 2023, governorship election. The All Progressives Congress (APC) chapter in Delta State has accepted the ruling of the Supreme Court.

This was said in a statement that Elder Omeni Sobotie, the APC Chairman in Delta State, signed.

Oborevwori was likewise praised by the APC on his legal triumph.

The APC claims, “Let us be clear. As the principal opposition party in Delta State, the APC will continue to lead by example and engage the government responsibly and firmly to ensure that its policies uphold the rule of law, equity, and good governance for the benefit of our people.

Presidential task force to expose corrupt practices by Economic and Financial Crimes Commission officers has been requested by Kayode Ajulo, a Senior Advocate of Nigeria.

Ola Olukoyede, the chairman of the EFCC, publicly stated that some of his officers were accepting payments from dishonest individuals who were being looked into.

In a January 18 speech to the commission’s employees, Olukoyede revealed this.

When speaking to reporters in Abuja on Saturday in response to the revelation, Ajulo urged the President to form a task group to investigate the actions of dishonest personnel inside the agency. He also stated that an organization tasked with combating corruption had to be ethical.

He stated that eliminating corrupt personnel from the EFCC will be the task force’s mandate, allowing it to carry out its duties more successfully.

The President should think about combining the EFCC and the Independent Corrupt Practices and Other Related Offenses Commission, the senior attorney asked the President to consider.

“With the immediate goal of identifying the individuals responsible for bribery within the EFCC, President Tinubu need to establish a presidential task team. A task force is currently required because the allegations were made by the commission chairman, according to Ajulo.

“The crucial duty of preventing, looking into, and prosecuting financial crimes has long been placed on the shoulders of the EFCC,” he continued.

A comprehensive review of the Commission’s purpose and efficacy is necessary, though, as recent events have given rise to questions over its activities and emphasis.

“It seems that the EFCC has moved away from its core duties and is instead participating in political posturing, which is regrettable.”

In light of this, Ajulo stated that it’s critical to assess the EFCC’s activities, correct any flaws, and reaffirm the organization’s dedication to its founding objectives.

The EFCC’s leadership, pertinent government agencies, the National Security Advisor, the Minister of Defense, civil society organizations, legal experts, and the media, he said, were all required to work together on this process.

The eminent jurist stated that the commission must consolidate its ability to effectively address financial and economic crimes, improve openness, and rebuild public confidence.

The Kano State gubernatorial election ruling from the Supreme Court has been examined, according to the All Progressives Congress (APC).

The party declared that it is working to forge a solid path that will bring its members together and embrace newcomers.

It was recalled that the Supreme Court upheld Kano State Governor Abba Yusuf’s election victory on Friday.

A group of Justices headed by Inyang Okoro unanimously restored his earlier triumph from the March 2023 election, which had been invalidated by the two lower courts.

The governor was first dismissed from office due to claims of irregularities during the contentious March 2023 election, but the Supreme Court overturned the concurrent rulings of the two lower courts.

The party expressed gratitude to President Bola Ahmed Tinubu for his support and commitment to Kano State and the APC family in a communiqué signed by Mallam Muhammad Garba, Chief of Staff to the APC National Chairman.

The party praised his dedication to the advancement and growth of the party throughout the nation and the state.

The stakeholders’ meeting decided to maintain the doors of the APC in Kano open to hundreds of new members who are eager to join, according to Mallam Muhammad Garba, speaking on behalf of the party.

He went on to say that because of the party’s good leadership and its promises, the party is actively looking to recruit new members on both an individual and group basis.

As Garba pointed out, the meeting also decided to call a large-scale stakeholders’ gathering in Kano to plan ways to further strengthen the party’s unity for better development.

He stated, “The meeting also called on the party’s members to maintain composure and await the outcome of the expanded stakeholders meeting scheduled for Thursday, January 25, 2024. It also appreciated the party’s members for their maturity, support, and patience during the legal battle.”
