Yesterday, a Federal High Court that was sitting in Lagos set the date of August 15 as the date that they will hear a motion that seeks to stop the prosecution of the suspended governor of the Central Bank of Nigeria, Godwin Emefiele.
On the same day, the court will also consider an application filed by the federal government on the same day seeking to appeal the bail that was granted to Mr. Emefiele by the court on July 25.
The date was set by the trial judge, Justice Nicholas Oweibo, after he listened to the arguments of the parties on whether they are ready for hearing or to enable the defence to reply to the prosecution’s further counter affidavit, which was served on the defence in court just before the proceedings began. The parties argued about whether they are ready for hearing or to enable the defence to reply to the prosecution’s further counter affidavit.
In making his decision regarding whether or not the applications were ready to be heard, the judge noted that the application of the prosecution had been concluded and was ready to be heard. However, due to the fact that the defence had not responded to the further counter affidavit that was served on him in court, the judge decided that it would be best for the applications to be taken jointly on the same day.
As a result, the judge postponed the case until August 15 in order to hear all of the applications.
A two-count accusation that broadly encompasses “illegal possession” of firearms will be brought against Emefiele when he stands trial.
