On Friday, the Nigerian Supreme Court upheld the Independent National Electoral Commission’s (INEC) decision to de-register 22 political parties.

Following their poor performance in the previous elections, the INEC decided to ban the parties in 2020.

On Friday, Justice Ejembi Eko issued a landmark decision in the case, nullifying and setting aside a Court of Appeal decision that had nullified the de-registration.

Justice Eko ruled that the Court of Appeal raised the issue of a lack of fair hearing in favor of the scrapped parties on its own (suo motu) and reached a decision without hearing from the other parties in the case.

“This INEC appeal is meritorious and is hereby granted.” The lower court’s decision is overturned,” the court ruled.
