The petition claimed that in order for presidential candidates to be considered the election’s winners, they must receive 25% of the votes cast in the Federal Capital Territory (FCT). However, the Presidential Election Petition Tribunal, which is based in Abuja, has disregarded this claim.

According to reports, the tribunal’s chief justice, Justice Haruna Simon Tsammani, ruled on September 6, 2023, that the Federal Capital Territory (FCT) has no special status and is on par with the other states in Nigeria.

The decision was reached in response to a plea that President Bola Tinubu’s election had been contested by the Labour Party and Peter Obi, the party’s presidential candidate. Because Tinubu did not receive 25% of the votes cast in the FCT, Obi had contended that he should be disqualified from serving as president.
