A suit challenging Governor Ben Ayade of Cross River’s defection from the People’s Democratic Party to the All Progressives Congress has been adjourned by a Federal High Court in Abuja.
The PDP, through its lawyer Emmanuel Ukala, had filed a lawsuit seeking an order sacking the governor and his deputy for their defection. This comes after 20 legislators in Cross River were fired for defecting to the All Progressives Congress, or APC.
The case against Ayade and his deputy has been set for today’s hearing. The case has been rescheduled for April 6, 2022, by Justice Taiwo Taiwo.
The court provided no explanation for why it will not hear the case on Friday.
“A declaration that, in view of the provisions of section 221 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and the democratic system of governance in Nigeria, votes at the election and elections are won by political parties and not their candidates or candidates sponsored at the election by political parties,” the PDP’s suit stated.
“INEC should immediately receive from the plaintiff (PDP) the names of its candidates to replace the 3rd and 4th defendants (Ayade and Esu) for the purpose of utilizing the lawful votes cast in the plaintiff’s favor, or, in the alternative, directing the 1st defendant to hold a gubernatorial election for Cross River State in accordance with Section 177 of the Constitution, excluding the 3rd and 4th defendants who are disqualified from participating in
