Asaba, in the state of Delta – Ndudi Elumelu was proclaimed the victor of the 2023 election by the National and State Houses of Assembly Election Tribunal in Asaba. However, the Court of Appeal in Abuja has overturned that decision.
According to The Nigerian, Elumelu is a representative for the Aniocha/Oshimili Federal Constituency in the state of Delta. He belongs to the People’s Democratic Party, also known as the PDP.Ngozi Okolie, a member of the Labour Party (LP), was deemed to be the victor of the election by the appellate court on Thursday, when it issued two separate decisions.
It criticized the trial tribunal for nullifying Okolie’s election and then went on to rule against Elumelu’s petition, which had been presented before the trial tribunal and constituted the basis for the verdict that had been nullified.
The Court of Appeal agreed with Okolie’s lawyer, Mahmud Magaji (SAN), that contrary to the finding of the tribunal, Okolie was duly nominated and sponsored by his party and that he resigned his appointment as a Senior Special Assistant (SSA) to Delta State Government as required by the Constitution. Mahmud Magaji is the lawyer for the Labour Party. The Court of Appeal found that Okolie was duly nominated and sponsored by his party.
