On Monday, the Action Alliance (AA) and its Presidential candidate, Solomon David Okanigbuan, withdrew their petition challenging the declaration of Bola Tinubu as the winner of the presidential election held on February 25. The petition was filed in an attempt to overturn the results of the election.

A motion to withdraw the petition was made by the petitioner’s attorney, Oba Maduabuchi (SAN), at the beginning of the pre-hearing session that was being held in Abuja by the Presidential Election Petition Court.

According to Maduabuchi, “We have a motion that was filed on May 3, seeking an order of the court for the withdrawal of our petition, and upon withdrawal, the petition should be dismissed”

The request to withdraw the petition was granted by Justice Haruna Tsamani, who led a five-member panel of Justices of the court, and this resulted in the petition being dismissed. The respondents in the case did not object to the request to withdraw the petition.

The petition that was submitted by the AA and its candidate for president has been rejected, meaning that the president-elect must now deal with a total of four petitions that question the legitimacy of his election.

Atiku Abubakar of the Peoples Democratic Party (PDP), Peter Obi of the Labour Party (LP), Action Peoples Party (APP), and the Allied Peoples Movement (APM) currently have petitions pending before the court, in which they seek the nullification of Tinubu’s election on the grounds of substantial non compliance with the provisions of the Constitution, the Electoral Act, and INEC’s guidelines for the conduct of the election.
